13         Senate Amendment (with title amendment) 
14         On page 2, between lines 12 and 13,
15  
16  insert:  
17         Section 1.  Section 787.05, Florida Statutes, is
18  created to read:
19         787.05  Unlawfully obtaining labor or services.--Any
20  person who knowingly obtains the labor or services of a person
21  by:
22         (1)  Causing or threatening to cause bodily injury to
23  that person or another person;
24         (2)  Restraining or threatening to restrain that person
25  or another person without lawful authority and against her or
26  his will; or
27         (3)  Withholding that person's governmental records,
28  identifying information, or other personal property,
29  
30  commits a felony of the second degree, punishable as provided
31  in s. 775.082, s. 775.083, or s. 775.084.

SENATE AMENDMENT Bill No. SB 1962 Amendment No. ___ Barcode 425110 1 Section 2. Section 787.06, Florida Statutes, is 2 created to read: 3 787.06 Human trafficking.-- 4 (1) As used in this section, the term: 5 (a) "Forced labor or services" means labor or services 6 obtained from a person by: 7 1. Using or threatening to use physical force against 8 that person or another person; or 9 2. Restraining or confining or threatening to restrain 10 or confine that person or another person without lawful 11 authority and against her or his will. 12 (b) "Human trafficking" means transporting, 13 soliciting, recruiting, harboring, providing, or obtaining 14 another person for transport. 15 (2) Any person who knowingly engages in human 16 trafficking with the intent that the trafficked person engage 17 in forced labor or services commits a felony of the second 18 degree, punishable as provided in s. 775.082, s. 775.083, or 19 s. 775.084. 20 21 (Redesignate subsequent sections.) 22 23 24 ================ T I T L E A M E N D M E N T =============== 25 And the title is amended as follows: 26 On page 1, line 2, delete that line 27 28 and insert: 29 An act relating to human trafficking; creating 30 s. 787.05, F.S.; specifying elements of the 31 offense of unlawfully obtaining labor or 2 11:22 AM 04/26/04 s1962c-3420d
