1 A bill to be entitled
2 An act relating to educational facilities;
3 amending s. 1013.735, F.S., relating to the
4 Classrooms for Kids Program; revising the
5 formula for determining each school district's
6 share of the annual appropriation for the
7 Classrooms for Kids Program; providing that a
8 percentage of the appropriation shall be used
9 to reduce class size; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (1) of section 1013.735, Florida
15 Statutes, is amended to read:
16 1013.735 Classrooms for Kids Program.--
17 (1) ALLOCATION.--The department shall allocate funds
18 appropriated for the Classrooms for Kids Program. It is the
19 intent of the Legislature that this program be administered as
20 nearly as practicable in the same manner as the capital outlay
21 program authorized under s. 9(a), Art. XII of the State
22 Constitution. Each district school board's share of the annual
23 appropriation for the Classrooms for Kids Program must be
24 calculated according to the following formula:
25 (a) Twenty-five percent of the appropriation shall be
26 prorated to the districts based on each district's percentage
27 of base capital outlay full-time equivalent membership, and 65
28 percent shall be based on each district's percentage of growth
29 capital outlay full-time equivalent membership averaged over
30 the previous 3 years as specified for the allocation of funds

1 from the Public Education Capital Outlay and Debt Service
2 Trust Fund by s. 1013.64(3).
3 (b) Sixty-five percent of the appropriation shall be
4 prorated to the districts based on each district's percentage
5 of the state's classroom needs to reduce class size pursuant
6 to s. 1003.03(2).
7 (c)(b) Ten percent of the appropriation shall be
8 prorated to the districts that currently meet the requirements
9 of s. 1003.03(1)(a), (b), or (c) must be allocated among
10 district school boards according to the allocation formula in
11 s. 1013.64(1)(a).
12 Section 2. This act shall take effect July 1, 2004.
