| 4 | Remove line(s) 747-760 and insert: |
| 5 | Section 19. Effective January 1, 2006, subsections (4) and |
| 6 | (13) of section 101.5606, Florida Statutes, are amended, and |
| 7 | subsections (16) and (17) are added to said section, to read: |
| 8 | 101.5606 Requirements for approval of systems.--No |
| 9 | electronic or electromechanical voting system shall be approved |
| 10 | by the Department of State unless it is so constructed that: |
| 11 | (4) For systems using marksense paper ballots, it accepts |
| 12 | a rejected ballot pursuant to subsection (3) if a voter chooses |
| 13 | to cast the ballot, but records no vote for any office that has |
| 14 | been overvoted or undervoted. |
| 15 | (13) It is capable of producing a voter-verified paper |
| 16 | record providing records from which the operation of the voting |
| 17 | system may be audited that meets the following requirements:. |
| 18 | (a) The voting system shall produce a permanent paper |
| 19 | record, which shall be made available for inspection and |
| 20 | verification by the voter at the time the vote is cast and which |
| 21 | shall be maintained and preserved by the supervisor of elections |
| 22 | in the manner in which all other paper ballots are preserved by |
| 23 | the supervisor for later use in any manual audit or recount. |
| 24 | (b) The voting system shall provide the voter with an |
| 25 | opportunity to correct any error made by the system before the |
| 26 | permanent record is preserved for use in any manual audit or |
| 27 | recount. |
| 28 | (c) The voter-verified paper record shall be the official |
| 29 | record used for any recount conducted with respect to any |
| 30 | election in which the system is used. |
| 31 | (d) The voter-verified paper record shall not be produced |
| 32 | on thermal paper. |
| 33 | (16) It cannot at any time contain or use undisclosed |
| 34 | software or does not contain any wireless communication device. |
| 35 | (17) All electronic voter interface devices are capable of |
| 36 | allowing voters to cast both regular and provisional ballots |
| 37 | while allowing the elections administrator to preserve the |
| 38 | secrecy of ballots. |
