3     Amendment (with title amendment)
4     Remove line(s) 747-760 and insert:
5     Section 19.  Effective January 1, 2006, subsections (4) and
6(13) of section 101.5606, Florida Statutes, are amended, and
7subsections (16) and (17) are added to said section, to read:
8     101.5606  Requirements for approval of systems.--No
9electronic or electromechanical voting system shall be approved
10by the Department of State unless it is so constructed that:
11     (4)  For systems using marksense paper ballots, it accepts
12a rejected ballot pursuant to subsection (3) if a voter chooses
13to cast the ballot, but records no vote for any office that has
14been overvoted or undervoted.
15     (13)  It is capable of producing a voter-verified paper
16record providing records from which the operation of the voting
17system may be audited that meets the following requirements:.
18     (a)  The voting system shall produce a permanent paper
19record, which shall be made available for inspection and
20verification by the voter at the time the vote is cast and which
21shall be maintained and preserved by the supervisor of elections
22in the manner in which all other paper ballots are preserved by
23the supervisor for later use in any manual audit or recount.
24     (b)  The voting system shall provide the voter with an
25opportunity to correct any error made by the system before the
26permanent record is preserved for use in any manual audit or
27recount.
28     (c)  The voter-verified paper record shall be the official
29record used for any recount conducted with respect to any
30election in which the system is used.
31     (d)  The voter-verified paper record shall not be produced
32on thermal paper.
33     (16)  It cannot at any time contain or use undisclosed
34software or does not contain any wireless communication device.
35     (17)  All electronic voter interface devices are capable of
36allowing voters to cast both regular and provisional ballots
37while allowing the elections administrator to preserve the
38secrecy of ballots.
