  1                      A bill to be entitled

  2         An act relating to public K-12 education;

  3         amending s. 1003.05, F.S.; allowing children of

  4         military personnel transferred to Florida after

  5         a school year has begun to enroll in certain

  6         schools or programs in the state; providing for

  7         priority listing for enrollment under certain

  8         circumstances; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (2) of section 1003.05, Florida

13  Statutes, is renumbered as subsection (3), and a new

14  subsection (2) is added to that section to read:

15         1003.05  Assistance to transitioning students from

16  military families.--

17         (2)  Children of military personnel who receive

18  military orders to transfer to Florida after a school year has

19  begun shall be allowed to enroll in a school or program

20  included in the public school choice options, listed in s.

21  1002.20(6)(a); in a public school that provides exceptional

22  student education; or in a public school exceptional student

23  program if they were enrolled in such a school or program in

24  the state from which transferred. A school's enrollment

25  deadline shall not prevent such student from enrolling in a

26  school or program pursuant to this subsection. However, if

27  such student is unable to enroll in a school or program

28  pursuant to this subsection due to space limitation, such

29  student shall be priority listed for enrollment for the

30  upcoming school term or school year.

31         Section 2.  This act shall take effect July 1, 2004.
