8 salary rate; amending s. 1001.47, F.S.;
9 providing a calculation methodology for the
10 salary for elected district school
11 superintendents based on county population;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (2) of section 145.19, Florida
17 Statutes, is amended to read:
18 145.19 Annual percentage increases based on increase
19 for state career service employees; limitation.--
20 (2) Each fiscal year, the salaries of all officials
21 listed in this chapter and s. 1001.47 shall be adjusted by the
22 annual factor. The Department of Management Services shall
23 certify the annual factor and the cumulative annual factors.
24 The adjusted salary rate shall be the product, rounded to the
25 nearest dollar, of the salary rate granted by the appropriate
26 section of this chapter or s. 1001.47 multiplied first by the
27 initial factor, then by the cumulative annual factor, and
28 finally by the annual factor. The Department of Management
29 Services shall certify the annual factor and the cumulative
30 annual factors. Any special qualification salary received
31 under this chapter, s. 1001.47, or the annual performance

1 salary incentive available to elected superintendents under s.
2 1001.47 shall be added to such adjusted salary rate. The,
3 which special qualification salary shall be $2,000, but shall
4 not exceed $2,000.
5 Section 2. Subsection (2) of section 1001.47, Florida
6 Statutes, is amended, subsections (3), (4), and (5) are
7 renumbered as subsections (4), (5), and (6), respectively, and
8 a new subsection (3) is added to that section, to read:
9 1001.47 District school superintendent; salary.--
10 (2) Each elected district school superintendent shall
11 receive a base salary, the amounts indicated below, based on
12 the population of the county the elected superintendent
13 serves. In addition, compensation shall be made for population
14 increments over the minimum for each population group, which
15 shall be determined by multiplying the population in excess of
16 the minimum for the group times the group rate. The product of
17 such calculation shall be added to the base salary to
18 determine the adjusted base salary. Laws that increase the
19 base salary provided in this subsection shall contain
20 provisions on no other subject.

1 Notwithstanding the provisions of chapter 145 to the contrary,
2 the annual salaries of elected district school superintendents
3 for 1993 and each year thereafter shall be established at the
4 same amounts as the district school superintendents were paid
5 for fiscal year 1991-1992, adjusted by each annual increase
6 provided for in chapter 145.
7 (3) The adjusted base salaries of elected district
8 school superintendents shall be increased annually as provided
9 for in s. 145.19. Any salary previously paid to elected
10 superintendents, including the salary calculated for fiscal
11 year 2002-2003, which was consistent with chapter 145 and s.
12 230.303, Florida Statutes (2001), is hereby ratified and
13 validated.
14 Section 3. This act shall take effect upon becoming a
15 law.
