1 A bill to be entitled
2 An act relating to the North Lake County
3 Hospital District, Lake County; amending s. 4
4 of chapter 2002-348, Laws of Florida; providing
5 for payment of tax proceeds to designees of the
6 Florida Hospital Waterman Foundation, Inc., and
7 Leesburg Regional Medical Center, Inc., under
8 specified circumstances; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsections D and E of section 4 of chapter
14 2002-348, Laws of Florida, are amended to read:
15 Section 4. POWERS, FUNCTIONS, AND DUTIES.--
16 D. Tax proceeds to charitable foundations;
17 hospitals.--All future tax proceeds generated from within the
18 Northeast Territory, less one-half of the amount reserved
19 annually by the board to pay for maintenance and services for
20 the board, shall be paid by the board of trustees to Florida
21 Hospital Waterman Foundation, Inc., or other entity determined
22 by Florida Hospital Waterman Foundation, Inc., if they so
23 desire in order to maximize moneys received, upon written
24 request by Florida Hospital Waterman Foundation, Inc., that
25 the funds are needed for health care. All future proceeds
26 generated from within the Northwest Territory, less one-half
27 of the amount reserved annually by the board to pay for
28 maintenance and services for the board, shall be paid by the
29 board of trustees to Leesburg Regional Medical Center
30 Charitable Foundation, Inc., or other entity determined by
31 Leesburg Regional Medical Center, Inc., if they so desire in

1 order to maximize moneys received, upon written request by
2 Leesburg Regional Medical Center Charitable Foundation, Inc.,
3 that the funds are needed for health care.
4 E. LifeStream Behavioral Center.--Leesburg Regional
5 Medical Center Charitable Foundation Foundations, Inc., and
6 Florida Hospital Waterman Foundation, Inc., have brought to
7 the attention of their the respective boards that LifeStream
8 Behavioral Center should be entitled to receive the following
9 sums, after submission of a written request by LifeStream
10 Behavioral Center certifying that the funds are needed for
11 indigent health care. The request shall be made to Florida
12 Hospital Waterman Foundation, Inc., and Leesburg Regional
13 Medical Center Charitable Foundation, Inc. Florida Hospital
14 Waterman Foundation, Inc., and Leesburg Regional Medical
15 Center Charitable Foundation, Inc., shall pay the following
16 sums to LifeStream Behavioral Center from their respective
17 share of tax funds collected and received by Florida Hospital
18 Waterman Foundation, Inc., and Leesburg Regional Medical
19 Center Charitable Foundation, Inc.
20 1. For each year after calendar year 1993, LifeStream
21 Behavioral Center shall be paid $100,000 or 1/20 of 1 mill
22 of the tax moneys due Florida Hospital Waterman Foundation,
23 Inc., from the Northeast Territory, whichever is greater, plus
24 $100,000 or 1/20 of 1 mill of the tax moneys due Leesburg
25 Regional Medical Center Charitable Foundation, Inc., from the
26 Northwest Territory, whichever is greater. If Florida Hospital
27 Waterman Foundation, Inc., or Leesburg Regional Medical Center
28 Charitable Foundation, Inc., refuses to pay LifeStream
29 Behavioral Center the funds due under this section in any
30 given year, during the next fiscal year of the Board of
31 Trustees of the North Lake County Hospital District, the Board

1 of Trustees of the North Lake County Hospital District shall
2 directly pay LifeStream Behavioral Center an amount equal to
3 the funds withheld during the previous year by the subject
4 provider payable from funds that which would otherwise be
5 payable to the subject provider.
6 2. Notwithstanding any of the provisions of this act,
7 the obligation to pay tax revenues to LifeStream Behavioral
8 Center under this act shall permanently terminate in the year:
9 a. When a countywide health taxing district is created
10 and funded pursuant to chapter 154, Florida Statutes, the
11 countywide health taxing district provides for reimbursement
12 on an accountability basis to medical providers for medical,
13 hospital, and emergency care, including psychiatric care
14 provided to indigents indigent residing within the county, and
15 the countywide health taxing district actually reimburses
16 LifeStream Behavioral Center for medical services in an amount
17 greater than or equal to the tax revenues received under the
18 provisions of this act in 1 calendar year; or
19 b. If LifeStream Behavioral Center, for any reason,
20 loses, relinquishes, or forfeits its accreditation as a
21 hospital.

23 Any reimbursement for medical services paid to LifeStream
24 Behavioral Center by any future countywide health taxing
25 district shall be deducted from the amount of tax revenues to
26 be paid under this act. It is the intent of this act that the
27 tax revenue revenues payments provided for LifeStream
28 Behavioral Center in this act be reduced by the same amount
29 that is actually paid to the hospital by the countywide taxing
30 district.

1 Section 2. This act shall take effect upon becoming a
2 law.
