3     Amendment (with title amendment)
4     Remove line 138 and insert:

6     Section 3.  Subsection (1) of section 311.12, Florida
7Statutes, is amended to read:
8     311.12  Seaport security standards.--
9     (1)(a)  The statewide minimum standards for seaport
10security for each seaport identified in s. 311.09 shall be those
11based upon the Florida Seaport Security Assessment 2000 and set
12forth in the "Port Security Standards--Compliance Plan"
13delivered to the Speaker of the House of Representatives and the
14President of the Senate on December 11, 2000, pursuant to this
15section. The statewide minimum standards are hereby adopted. The
16Office of Drug Control within the Executive Office of the
17Governor shall maintain a sufficient number of copies of the
18standards for use of the public, at its offices, and shall
19provide copies to each affected seaport upon request.
20     (b)  The Department of Law Enforcement may exempt any
21seaport identified in s. 311.09 from all or part of the
22requirements of subsections (1)-(5) if the department determines
23that the seaport is not active. The department shall
24periodically review exempted seaports to determine if there is
25maritime activity at the seaport. A change in status from
26inactive to active may warrant removal of all or part of any
27exemption provided by the department.
28     (c)  All entities, whether public or private, operating on
29public property on a public seaport identified in s. 311.09 and
30subject to inspection pursuant to paragraph (b), must conform to
31all security provisions of this section.
32     Section 4.  This act shall take effect upon becoming a law.

39any public or private entity that operates within the boundaries
40of a public seaport in the state to meet minimum statewide
