4 | On page 38, between lines 5 and 6, insert: |
5 | Section 22. Subsection (7) of section 440.16, Florida |
6 | Statutes, is repealed: |
7 | 440.16 Compensation for death.-- |
8 | (7) Compensation under this chapter to aliens not |
9 | residents (or about to become nonresidents) of the United States |
10 | or Canada shall be the same in amount as provided for residents, |
11 | except that dependents in any foreign country shall be limited |
12 | to surviving spouse and child or children, or if there be no |
13 | surviving spouse or child or children, to surviving father or |
14 | mother whom the employee has supported, either wholly or in |
15 | part, for the period of 1 year prior to the date of the injury, |
16 | and except that the judge of compensation claims may, at the |
17 | option of the judge of compensation claims, or upon the |
18 | application of the insurance carrier, commute all future |
19 | installments of compensation to be paid to such aliens by paying |
20 | or causing to be paid to them one-half of the commuted amount of |
21 | such future installments of compensation as determined by the |
22 | judge of compensation claims, and provided further that |
23 | compensation to dependents referred to in this subsection shall |
24 | in no case exceed $75,000. |
