11  Senator Aronberg moved the following amendment:

13         Senate Amendment (with title amendment) 
14         Delete everything after the enacting clause
15  
16  and insert:  
17         Section 1.  Paragraph (hh) is added to subsection (3)
18  of section 119.07, Florida Statutes, to read:
19         119.07  Inspection, examination, and duplication of
20  records; exemptions.--
21         (3)
22         (hh)  Any information that would identify or help to
23  locate a child who participates in government-sponsored
24  recreation programs or camps or the parents or guardians of
25  such child, including, but not limited to, the name, home
26  address, telephone number, social security number, or
27  photograph of the child; the names and locations of schools
28  attended by the child; and the names, home addresses, and
29  social security numbers of the parents or guardians of the
30  child is exempt from subsection (1) and s. 24(a), Art. I of
31  the State Constitution. Information made exempt under this

This exemption applies to records held before, on, 3 or after the effective date of this exemption. 4 Section 2. Paragraph (hh) of subsection (3) of section 5 119.07, Florida Statutes, is subject to the Open Government 6 Sunset Review Act of 1995 in accordance with section 119.15, 7 Florida Statutes, and shall stand repealed on October 2, 2009, 8 unless reviewed and saved from repeal through reenactment by 9 the Legislature. 10 Section 3. The Legislature finds that it is a public 11 necessity that any information that would identify or help to 12 locate a child who participates in government-sponsored 13 recreation programs or camps or the parents or guardians of 14 the child, including, but not limited to, the name, home 15 address, telephone number, social security number, and 16 photograph of the child, the names and locations of the 17 schools attended by the child, and the names, home addresses, 18 and social security numbers of the parents or guardians of the 19 child, be held exempt from public records requirements because 20 revealing the information could create the opportunity for 21 stalking, harassment, abduction, or abuse of these children. 22 Information that identifies a child in a government-sponsored 23 recreation program or camp could be used directly to locate 24 that child. Information that identifies a parent or guardian 25 of a child could be used indirectly to lead to the location of 26 the child. As the public availability of this information 27 could create the opportunity for stalking, harassment, 28 abduction, or abuse of these children, it would be contrary to 29 the state's compelling interest in preserving the public 30 safety to permit the release of this information.
