  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         410.706, F.S.; creating the Elder Victims Trust

  4         Fund within the Department of Elderly Affairs;

  5         providing for sources of moneys and purposes;

  6         providing for annual carryforward of unused

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Section 410.706, Florida Statutes, is

14  created to read:

15         410.706  Elder Victims Trust Fund.--

16         (1)  There is created the Elder Victims Trust Fund

17  within the Department of Elderly Affairs. Funds shall be

18  credited to the trust fund as provided by law to be used for

19  the investigation and prosecution of financial exploitation

20  against elderly persons and for education initiatives directed

21  toward elderly persons, law enforcement officers, the judicial

22  system, social services professionals, and the public on

23  financial exploitation of elderly persons.

24         (2)  Notwithstanding the provisions of s. 216.301, and

25  pursuant to s. 216.351, any balance in the trust fund at the

26  end of any fiscal year shall remain in the trust fund at the

27  end of the year and shall be available for carrying out the

28  purposes of the trust fund.

29         (3)  In accordance with s. 19(f)(2), Art. III of the

30  State Constitution, the trust fund shall, unless terminated

31  sooner, be terminated on July 1, 2008. Before its scheduled

 1  termination, the trust fund shall be reviewed as provided in

 2  s. 215.3206(1) and (2).

 3         Section 2.  This act shall take effect July 1, 2004, if

 4  Senate Bill _____ or similar legislation is adopted in the

 5  same legislative session or an extension thereof and becomes

 6  law.
