13         Senate Amendment (with title amendment) 
14         On page 205, lines 14-16, delete those lines
15  
16  and insert:  
17         Section 138.  Subsections (1), (9), and (11) of section
18  400.9935, Florida Statutes, are amended to read:
19         400.9935  Clinic responsibilities.--
20         (1)  Each clinic shall appoint a medical director or
21  clinic director who shall agree in writing to accept legal
22  responsibility for the following activities on behalf of the
23  clinic. The medical director or the clinic director shall:
24         (a)  Have signs identifying the medical director or
25  clinic director posted in a conspicuous location within the
26  clinic readily visible to all patients.
27         (b)  Ensure that all practitioners providing health
28  care services or supplies to patients maintain a current
29  active and unencumbered Florida license.
30         (c)  Review any patient referral contracts or
31  agreements executed by the clinic.

Amendment No. ___ Barcode 101526 1 (d) Ensure that all health care practitioners at the 2 clinic have active appropriate certification or licensure for 3 the level of care being provided. 4 (e) Serve as the clinic records owner as defined in s. 5 456.057. 6 (f) Ensure compliance with the recordkeeping, office 7 surgery, and adverse incident reporting requirements of 8 chapter 456, the respective practice acts, and rules adopted 9 under this part and part II of chapter 408. 10 (g) Conduct systematic reviews of clinic billings to 11 ensure that the billings are not fraudulent or unlawful. Upon 12 discovery of an unlawful charge, the medical director or 13 clinic director shall take immediate corrective action. If the 14 clinic performs only the technical component of magnetic 15 resonance imaging, static radiographs, computed tomography, or 16 position emission tomography, and provides the professional 17 interpretation of such services, in a fixed facility that is 18 accredited by the Joint Commission on Accreditation of 19 Healthcare Organizations or the Accreditation Association for 20 Ambulatory Health Care, and the American College of Radiology; 21 and if, in the preceding quarter, the percentage of scans 22 performed by that clinic which was billed to all personal 23 injury protection insurance carriers was less than 15 percent, 24 the chief financial officer of the clinic may, in a written 25 acknowledgement provided to the agency, assume the 26 responsibility for the conduct of the systematic reviews of 27 clinic billings to ensure that the billings are not fraudulent 28 or unlawful. 29 30 31 2 12:00 PM 04/24/04 s2170c2c-2020i
