11  Senator Peaden moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 142, line 16, through
15            page 143, line 7  delete those lines
16  
17  and insert:  
18         Section 96.  Paragraph (e) is added to subsection (4)
19  of section 491.014, Florida Statutes, to read:
20         491.014  Exemptions.--
21         (4)  No person shall be required to be licensed,
22  provisionally licensed, registered, or certified under this
23  chapter who:
24         (e)  Is a former salaried employee of the Department of
25  Corrections that at the time of government employment, the
26  agency contracted with a private provider for the continuation
27  of similar services and the employee was hired by the private
28  provider to perform the same essential duties for which he or
29  she was trained and hired by the government agency, under
30  clinical supervision of a duly licensed psychologist, and so
31  long as the employee is not held out to the public as a

 1  psychologist under s. 490.012(1)(a). For contracts entered
 2  into under this subsection, the private provider shall be
 3  liable and shall indemnify, defend, and hold the contracting
 4  agency, its employees; agents, officers, and assignees
 5  harmless from any and all claims, suits, judgments, or damages
 6  including court costs and attorneys' fees arising out of
 7  intentional acts, negligence, or omissions by the provider, or
 8  its employees or agents, in the course of the operations of
 9  this contract, including any claims or actions brought under
10  Title 42 U.S.C. ss. 1983, the Civil Rights Act.
