11  Senator Peaden moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 128, line 15, through
15            page 129, line 4  delete those lines
16  
17  and insert:  
18         Section 92.  Paragraph (g) is added to subsection (2)
19  of section 490.014, Florida Statutes, to read:
20         490.014  Exemptions.--
21         (2)  No person shall be required to be licensed or
22  provisionally licensed under this chapter who:
23         (g)  Is a former salaried employee of the Department of
24  Corrections that at the time of government employment, the
25  agency contracted with a private provider for the continuation
26  of similar services and the employee was hired by the private
27  provider to perform the same essential duties for which he or
28  she was trained and hired by the government agency, under
29  clinical supervision of a duly licensed psychologist, and so
30  long as the employee is not held out to the public as a
31  psychologist under s. 490.012(1)(a). For contracts entered

 2  liable and shall indemnify, defend, and hold the contracting
 3  agency, its employees; agents, officers, and assignees
 4  harmless from any and all claims, suits, judgments, or damages
 5  including court costs and attorneys' fees arising out of
 6  intentional acts, negligence, or omissions by the provider, or
 7  its employees or agents, in the course of the operations of
 8  this contract, including any claims or actions brought under
 9  Title 42 U.S.C. ss. 1983, the Civil Rights Act.
