1 A bill to be entitled
2 An act relating to electronic medical records;
3 creating the Statewide Electronic Medical
4 Records Advisory Panel to advise the Agency for
5 Health Care Administration in developing
6 policies relating to electronic medical
7 records; requiring the Governor to appoint
8 members to the advisory panel; requiring
9 quarterly meetings; authorizing per diem
10 reimbursement for members of the advisory
11 panel; requiring the agency to provide
12 personnel support to the advisory panel;
13 authorizing the agency to enter into contracts;
14 requiring that certain issues be studied by the
15 advisory panel; requiring the advisory panel to
16 issue an annual report; providing for the
17 contents of any implementation plan proposed by
18 the advisory panel; providing for expiration of
19 the panel; providing an appropriation;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. The Statewide Electronic Medical Records
25 Advisory Panel is created to serve as a body of experts to
26 advise the Agency for Health Care Administration in developing
27 policies related to electronic medical records and the
28 technology required for sharing clinical information among
29 caregivers.
30 (1) The advisory panel shall be appointed by the
31 Governor and meet at least quarterly.

1 (2) Members of the advisory panel shall serve without
2 compensation but are entitled to reimbursement for per diem
3 and travel expenses as provided in section 112.061, Florida
4 Statutes.
5 (3) The agency shall provide personnel to support the
6 functions of the advisory panel and to assist the panel in
7 creating the electronic medical records system. The agency may
8 enter into contracts to carry out this act.
9 (4) The advisory panel shall advise the Governor, the
10 Legislature, and the agency on the:
11 (a) Public and private sector initiatives relating to
12 electronic medical records and the communication systems used
13 to share clinical information among caregivers;
14 (b) Regulatory barriers that interfere with the
15 sharing of clinical information among caregivers;
16 (c) Investment incentives that might be used to
17 promote the use of recommended technologies by health care
18 providers;
19 (d) Educational strategies that could be implemented
20 to educate health care providers about the recommended
21 technologies for sharing clinical information; and
22 (e) Standards for public access to facilitate the
23 disclosure of pricing, costs, and quality.
24 (5) The advisory panel shall send to the Governor, the
25 President of the Senate, and the Speaker of the House of
26 Representatives a report by November 30, 2004, and annually
27 thereafter. Each report must include any recommendations or
28 implementation plan developed by the advisory panel. If the
29 advisory panel proposes an implementation plan, the proposed
30 plan must include, but need not be limited to, the capital
31 investment required to begin implementing the system; the

1 costs to operate the system; the financial incentives
2 recommended to increase capital investment; data concerning
3 the providers initially committed to participate in the
4 system, by region; the standards for systemic functionality
5 and features; any marketing plan to increase participation;
6 and implementation schedules for key components.
7 (6) This act expires July 1, 2007.
8 Section 2. The sum of $2 million is appropriated from
9 the General Revenue Fund to the Agency for Health Care
10 Administration for the purpose of implementing this act during
11 the 2004-2005 fiscal year.
12 Section 3. This act shall take effect upon becoming a
13 law.
