| 1 | A bill to be entitled | 
| 2 | An act relating to self-murder; creating s. 782.081, F.S.; | 
| 3 | defining the terms "deliberately assisting," "self- | 
| 4 | murder," and "simulated self-murder"; prohibiting | 
| 5 | conducting an event or providing a location for an event | 
| 6 | that the person knows or reasonably should know includes | 
| 7 | the act of self-murder; prohibiting deliberately assisting | 
| 8 | in a self-murder; providing an exception for events in | 
| 9 | which simulated self-murder is conducted; providing that a | 
| 10 | violation of the act is a third-degree felony; authorizing | 
| 11 | the Attorney General and state attorneys to enforce the | 
| 12 | act through civil proceedings; providing an effective | 
| 13 | date. |

| 15 | Be It Enacted by the Legislature of the State of Florida: | 
| 16 | 
 | 
| 17 | Section 1.  Section 782.081, Florida Statutes, is created | 
| 18 | to read: | 
| 19 | 782.081  Commercial exploitation of self-murder.-- | 
| 20 | (1)  As used in this section, the term: | 
| 21 | (a)  "Deliberately assisting" means carrying out a public | 
| 22 | act that is intended to: | 
| 23 | 1.  Aid, abet, facilitate, permit, advocate, or encourage; | 
| 24 | 2.  Publicize, promote, advertise, operate, stage, | 
| 25 | schedule or conduct; | 
| 26 | 3.  Provide or secure a venue, transportation, or | 
| 27 | security; or | 
| 28 | 4.  Result in the collection of an admission or fee. | 
| 29 | (b)  "Self-murder" means the voluntary and intentional | 
| 30 | taking of one's own life. As used in this section, the term | 
| 31 | includes attempted self-murder. | 
| 32 | (c)  "Simulated self-murder" means the artistic depiction | 
| 33 | or portrayal of self-murder which is not an actual self-murder. | 
| 34 | The term includes, but is not limited to, an artistic depiction | 
| 35 | or portrayal of self-murder in a script, play, movie, or story | 
| 36 | presented to the public or during an event. | 
| 37 | (2)  A person may not for commercial or entertainment | 
| 38 | purposes: | 
| 39 | (a)  Conduct any event that the person knows or reasonably | 
| 40 | should know includes an actual self-murder as a part of the | 
| 41 | event or deliberately assist in an actual self-murder. | 
| 42 | (b)  Provide a theater, auditorium, club, or other venue | 
| 43 | or location for any event that the person knows or reasonably | 
| 44 | should know includes an actual self-murder as a part of the | 
| 45 | event. | 
| 46 | (3)  This section does not prohibit any event during which | 
| 47 | simulated self-murder will occur. | 
| 48 | (4)  It is not a defense to a prosecution under this | 
| 49 | section that an attempted self-murder did not result in a self- | 
| 50 | murder. | 
| 51 | (5)  A person who violates this section commits a felony | 
| 52 | of the third degree, punishable as provided in s. 775.082, s. | 
| 53 | 775.083, or s. 774.084. | 
| 54 | (6)  The Attorney General or any state attorney may bring | 
| 55 | a civil proceeding for declaratory, injunctive, or other relief | 
| 56 | to enforce the provisions of this section. | 
| 57 | Section 2.  This act shall take effect upon becoming a | 
| 58 | law. |
