  1                      A bill to be entitled

  2         An act relating to educational facilities;

  3         creating s. 1013.101, F.S.; allowing the use of

  4         school board property as a public park under an

  5         agreement between a school board and a local

  6         government; absolving the school board from

  7         liability for injuries resulting from such use;

  8         providing restrictions on such use; providing

  9         an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 1013.101, Florida Statutes, is

14  created to read:

15         1013.101  Joint use of school property for public park

16  purposes.--

17         (1)  A school board may designate specific areas of

18  school board property that may be used as a public park

19  pursuant to an interlocal agreement with a municipal or county

20  government.

21         (2)  The school board is not liable for injuries to any

22  individual or property which occur as a result of the use of

23  the property as a public park.

24         (3)  The area designated for use as a public park may

25  not be used as a public park during school hours or when the

26  school is otherwise using the area for after-school

27  activities.

28         Section 2.  This act shall take effect upon becoming a

29  law.
