1 A bill to be entitled
2 An act relating to limitation on liability for
3 persons or political subdivisions providing
4 streetlights, security lights, or other similar
5 illumination; providing that a person or
6 political subdivision that provides, operates,
7 or maintains streetlights or other similar
8 illumination is not liable for civil damages
9 for injury or death effected or caused by the
10 adequacy or failure of illumination of the
11 lights, regardless whether the adequacy or
12 failure of illumination is alleged or
13 demonstrated to have caused or contributed in
14 any way to the injury or death; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Limitation on liability for persons or
20 political subdivisions providing streetlights, security
21 lights, or other similar illumination.--Any person, as defined
22 in section 1.01(3), Florida Statutes, or any political
23 subdivision, as defined in section 1.01(8), Florida Statutes,
24 that provides, operates, or maintains streetlights, security
25 lights, or other similar illumination may not be held liable
26 for any civil damages for injury or death effected or caused
27 by the adequacy or failure of illumination of the lights,
28 regardless of whether the adequacy or failure of illumination
29 is alleged or demonstrated to have caused or contributed in
30 any way to the injury or death. No person or political
31 subdivision that provides, operates, or maintains a manner of

1 illumination described above owes a duty to the public to
2 provide, operate, or maintain the illumination in any manner.
3 Section 2. This act shall take effect July 1, 2004.

6 SENATE SUMMARY
7 Provides that any person or political subdivision that
provides, operates, or maintains streetlights or other
8 similar illumination is not liable for civil damages for
injury or death effected or caused by the adequacy or
9 failure of illumination of the lights, regardless of
whether the adequacy or failure of illumination is
10 alleged or demonstrated to have caused or contributed in
any way to the injury or death.
