| 10 | 440.16 Compensation for death.-- |
| 11 | (7) Compensation under this chapter to aliens not |
| 12 | residents (or about to become nonresidents) of the United States |
| 13 | or Canada shall be the same in amount as provided for residents, |
| 14 | except that dependents in any foreign country shall be limited |
| 15 | to surviving spouse and child or children, or if there be no |
| 16 | surviving spouse or child or children, to surviving father or |
| 17 | mother whom the employee has supported, either wholly or in |
| 18 | part, for the period of 1 year prior to the date of the injury, |
| 19 | and except that the judge of compensation claims may, at the |
| 20 | option of the judge of compensation claims, or upon the |
| 21 | application of the insurance carrier, commute all future |
| 22 | installments of compensation to be paid to such aliens by paying |
| 23 | or causing to be paid to them one-half of the commuted amount of |
| 24 | such future installments of compensation as determined by the |
| 25 | judge of compensation claims, and provided further that |
| 26 | compensation to dependents referred to in this subsection shall |
| 27 | in no case exceed $75,000. |
