11  Senator Alexander moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 21, following line 31,
15  
16  insert:  
17         Section 2.  Section 627.0915, Florida Statutes, is
18  amended to read:
19         627.0915  Rate filings; workers' compensation,
20  drug-free workplace, and safe employers.--
21         (1)  The office shall approve rating plans for workers'
22  compensation and employer's liability insurance that give
23  specific identifiable consideration in the setting of rates to
24  employers that either implement a drug-free workplace program
25  pursuant to s. 440.102 and rules adopted thereunder by the
26  commission or implement a safety program pursuant to
27  provisions of the rating plan or implement both a drug-free
28  workplace program and a safety program. The plans must be
29  actuarially sound and must state the savings anticipated to
30  result from such drug-testing and safety programs.
31         (2)  An insurer offering a rate plan approved under

 1  this section shall notify the employer at the time of a
 2  written offer of insurance and at the time of each renewal of
 3  the policy of the availability of the premium discount where a
 4  drug-free workplace plan is used by the employer pursuant to
 5  s. 440.102 and related rules. The commission shall adopt rules
 6  to implement this section.
