1 A bill to be entitled
2 An act relating to admission to state
3 universities; providing the popular name the
4 "Thurgood Marshall University Opportunity Act";
5 amending s. 1007.261, F.S.; authorizing each
6 university to use race as one of the criteria
7 for admission; amending ss. 1004.39 and
8 1004.40, F.S.; deleting a restriction that
9 prohibits the college of law at Florida
10 International University and the college of law
11 at Florida Agricultural and Mechanical
12 University from using race as a preference in
13 the admissions process; providing an effective
14 date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. This act shall be known by the popular name
19 the "Thurgood Marshall University Opportunity Act."
20 Section 2. Subsection (11) is added to section
21 1007.261, Florida Statutes, to read:
22 1007.261 State universities; admissions of
23 students.--Each university board of trustees is authorized to
24 adopt rules governing the admission of students, subject to
25 this section and rules of the State Board of Education.
26 (11) Each university may use race as one of the
27 criteria for admission.
28 Section 3. Subsection (6) of section 1004.39, Florida
29 Statutes, is amended to read:
30 1004.39 College of law at Florida International
31 University.--

1 (6) The college of law at Florida International
2 University shall be dedicated to providing opportunities for
3 minorities to attain representation within the legal
4 profession proportionate to their representation in the
5 general population; however, the college of law shall not
6 include preferences in the admissions process for applicants
7 on the basis of race, national origin, or gender.
8 Section 4. Subsection (6) of section 1004.40, Florida
9 Statutes, is amended to read:
10 1004.40 College of law at Florida Agricultural and
11 Mechanical University.--
12 (6) The college of law at Florida Agricultural and
13 Mechanical University shall be dedicated to providing
14 opportunities for minorities to attain representation within
15 the legal profession proportionate to their representation in
16 the general population; however, the college of law shall not
17 include preferences in the admissions process for applicants
18 on the basis of race, national origin, or gender.
19 Section 5. This act shall take effect upon becoming a
20 law.
