1 A bill to be entitled
2          An act relating to use of social security numbers in
3    public postsecondary education; creating s. 1004.09, F.S.;
4    prohibiting certain uses of a student's social security
5    number by state universities and community colleges;
6    providing exceptions; requiring the development and
7    implementation of a plan by each state university and
8    community college; providing for injunctive relief;
9    providing an effective date.

11          Be It Enacted by the Legislature of the State of Florida:
12         
13          Section 1. Section 1004.09, Florida Statutes, is created
14    to read:
15          1004.09 Improper use of social security numbers.--
16          (1) No state university or community college shall:
17          (a) Use a social security number as an identification
18    number to identify a student.
19          (b) Publicly post or publicly display in any manner a
20    student's social security number. "Publicly post" or "publicly
21    display" means to intentionally communicate or otherwise make
22    available to the general public. This paragraph does not apply
23    to records of the clerks of court that are governed by the
24    provisions of s. 119.07(3)(ff).
25          (c) Print a student's social security number on any
26    identification document issued by a state university or
27    community college. An identification document includes, but is
28    not limited to, a professional license, student identification
29    card, driver's license, Medicaid card, or health insurance card.
30          (d) Require a student to transmit his or her social
31    security number over the Internet unless the connection is
32    secure and the social security number is encrypted.
33          (e) Require a student to use his or her social security
34    number to access an Internet website unless a password or unique
35    personal identification number or other authentication device is
36    also required to access the Internet website.
37          (2) Each state university and community college shall
38    develop a plan to implement the requirements of subsection (1)
39    which shall apply to students enrolled after July 1, 2005. The
40    plan shall include provisions for educating staff regarding the
41    proper and improper uses of social security numbers. The plan
42    shall be submitted to the Governor, the President of the Senate,
43    and the Speaker of the House of Representatives by February 1,
44    2005, and shall be implemented no later than July 1, 2005.
45          (3) Beginning July 1, 2005, any affected student may
46    petition the circuit court for an order directing compliance
47    with this section.
48          Section 2. This act shall take effect July 1, 2004.
