1 A bill to be entitled
2 An act relating to working waterfronts;
3 defining the term "working waterfront";
4 providing requirements of counties and
5 governmental entities with respect to working
6 waterfronts; requiring a study and report to
7 the Governor and Legislature; providing an
8 effective date.

10 WHEREAS, the Legislature recognizes there is a
11 significant interest in the availability and economic impact
12 of public marinas and public boat ramps along the navigable
13 waterways in this state, and
14 WHEREAS, it is the interest of the Legislature that
15 local governmental comprehensive plans encourage the
16 availability of working waterfronts by means of restrictions
17 or incentives, NOW, THEREFORE,

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Definition.--As used in this act, the term
22 "working waterfront" means a facility that requires direct
23 access to or location in marine waters and therefore cannot be
24 located inland, including, but not limited to, public marinas,
25 public boat ramps, boat hauling and repair facilities,
26 waterfront recreational facilities, commercial fishing
27 facilities, and boating facilities.
28 Section 2. Requirements.--
29 (1) Each county government through its comprehensive
30 plan is authorized to provide a sufficient number of boat
31 ramps to achieve a boat trailer parking capacity of 5 percent

1 of the registered available vessels within its jurisdiction by
2 July 1, 2014.
3 (2) A governmental entity that removes a working
4 waterfront facility for any development and thereby limits
5 public access to the working waterfront must replace the
6 facility within its jurisdiction. The replacement facility
7 must be substantially the same, provide similar access to
8 navigable waterways, and be available for use when the
9 existing working waterfront facility is removed.
10 Section 3. Working waterfront study.--The Department
11 of Community Affairs shall commission a study on the economic
12 trends of the working waterfronts of the state and the impact
13 the loss of critical working waterfronts would have on the
14 state's economy. The study shall include, but not be limited
15 to, findings concerning coastal and waterway development
16 trends and their impact on the working waterfronts. The study
17 shall be completed no later than November 1, 2004, and a
18 written report on the conclusions of this study shall be
19 submitted to the Governor, the President of the Senate, and
20 the Speaker of the House of Representatives.
21 Section 4. This act shall take effect upon becoming a
22 law.
