1 A bill to be entitled
2 An act relating to dentistry; amending s.
3 466.004, F.S.; revising membership, meetings,
4 and duties of the Council on Dental Hygiene;
5 providing duties of the Board of Dentistry with
6 respect to rule and policy recommendations of
7 the council; providing for resolution by the
8 Department of Health of disagreements between
9 the council and board with respect to such
10 recommendations; amending s. 466.023, F.S.;
11 authorizing dental hygienists to assess and
12 refer patients for dental examinations at
13 certain facilities, institutions, and places;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Paragraph (a) of subsection (2) of section
19 466.004, Florida Statutes, is amended to read:
20 466.004 Board of Dentistry.--
21 (2) To advise the board, it is the intent of the
22 Legislature that councils be appointed as specified in
23 paragraphs (a), (b), and (c). The department shall provide
24 administrative support to the councils and shall provide
25 public notice of meetings and agenda of the councils. Councils
26 shall include at least one board member who shall chair the
27 council and shall include nonboard members. All council
28 members shall be appointed by the board chair. Council members
29 shall be appointed for 4-year terms, and all members shall be
30 eligible for reimbursement of expenses in the manner of board
31 members.

1 (a) A Council on Dental Hygiene shall be appointed by
2 the board chair and shall include one dental hygienist member
3 of the board, who shall chair the council, one dental member
4 of the board, and four three dental hygienists recommended by
5 the Florida Dental Hygiene Association who are actively
6 engaged in the practice of dental hygiene in this state. The
7 council shall meet at least three times each calendar year.
8 Additional meetings may be called at the request of the board
9 chair, a majority of the members of the council board, or the
10 council chair. The council is charged with the responsibility
11 of and shall meet for the purpose of developing all rules and
12 policies relating to for recommendation to the board, which
13 the board shall consider, on matters pertaining to that part
14 of dentistry consisting of educational, preventive, or
15 therapeutic dental hygiene services; dental hygiene licensure,
16 discipline, or regulation; and dental hygiene education, which
17 the council shall submit to the board as recommendation. Rule
18 and policy recommendations of the council shall be considered
19 by the board immediately following the submission of the
20 proposed rule in the same manner as it considers rule and
21 policy recommendations from designated subcommittees of the
22 board. Any rule or policy proposed by the board pertaining to
23 the specified part of dentistry defined by this paragraph
24 shall be referred to the council for a recommendation prior to
25 final action by the board. If the council disagrees with such
26 finding of the board, the department shall determine whether
27 the board must ratify the recommendation.
28 Section 2. Paragraph (c) of subsection (2) and
29 subsection (3) of section 466.023, Florida Statutes, are
30 amended to read:

1 466.023 Dental hygienists; scope and area of
2 practice.--
3 (2) Dental hygienists may perform their duties:
4 (c) Upon a patient of record of a dentist who has
5 issued a prescription for the services of a dental hygienist,
6 which prescription shall be valid for 2 years unless a shorter
7 length of time is designated by the dentist, in:
8 1. Licensed public and private health facilities.;
9 2. Other public institutions of the state and federal
10 government.;
11 3. Public and private educational institutions.;
12 4. The home of a nonambulatory patient.; and
13 5. Other places in accordance with the rules of the
14 board.

16 However, the dentist issuing such prescription shall remain
17 responsible for the care of such patient. As used in this
18 subsection, "patient of record" means a patient upon whom a
19 dentist has taken a complete medical history, completed a
20 clinical examination, recorded any pathological conditions,
21 and prepared a treatment plan.
22 (3) Dental hygienists may, without supervision,
23 provide educational programs, faculty or staff training
24 programs, and authorized fluoride rinse programs; assess and
25 refer patients for dental examinations at those facilities,
26 institutions, and places listed under paragraph (2)(c);, and
27 provide other services which do not involve diagnosis or
28 treatment of dental conditions and which services are approved
29 by rule of the board.
30 Section 3. This act shall take effect July 1, 2004.
