  2         An act relating to trust funds; creating s.

  3         376.90, F.S.; creating the Shooting Range

  4         Cleanup Trust Fund within the Department of

  5         Environmental Protection; providing for sources

  6         of funds and purposes; exempting the trust fund

  7         from certain service charges; providing for

  8         interest earnings to be invested and credited

  9         to the trust fund; providing for the transfer

10         and use of moneys in the trust fund upon the

11         fund's termination; providing for the annual

12         carryforward of funds; providing for future

13         review and termination or re-creation of the

14         trust fund; providing a contingent effective

15         date.

17  Be It Enacted by the Legislature of the State of Florida:

18  

19         Section 1.  Section 376.90, Florida Statutes, is

20  created to read:

21         376.90  Shooting Range Cleanup Trust Fund.--

22         (1)  The Shooting Range Cleanup Trust Fund is created

23  within, and shall be administered by, the Department of

24  Environmental Protection. The fund shall receive fees as

25  provided by law and such other moneys as may be appropriated

26  by the Legislature. The purpose of the trust fund is to

27  facilitate the cleanup of outdoor shooting ranges pursuant to

28  the provisions of s. 790.333.

29         (2)  The trust fund is exempt from the service charges

30  imposed by s. 215.20. Interest earned on moneys in the trust

 1  fund shall be invested and reinvested to the credit of the

 2  trust fund in accordance with s. 17.61.

 3         (3)  Any funds remaining in the trust fund upon its

 4  termination date shall be transferred to the Lifetime Fish and

 5  Wildlife Trust Fund of the Fish and Wildlife Conservation

 6  Commission. Notwithstanding s. 372.105, such funds shall be

 7  used solely to support shooting and hunting activities for

 8  youth through an agreement with the Wildlife Foundation of

 9  Florida, Inc.

10         (4)  Notwithstanding s. 216.301 and pursuant to s.

11  216.351, any balance in the trust fund at the end of any

12  fiscal year shall remain in the trust fund at the end of the

13  fiscal year and shall be available for carrying out the

14  purposes of the trust fund.

15         (5)  In accordance with s. 19(f)(2), Art. III of the

16  State Constitution, the trust fund must, unless terminated

17  sooner, be terminated on July 1, 2008. Before its scheduled

18  termination, the trust fund must be reviewed as provided in s.

19  215.3206(1) and (2).

20         Section 2.  This act shall take effect on the effective

21  date of CS for CS for SB 1156, or similar legislation

22  providing for the cleanup of outdoor shooting ranges, but it

23  shall not take effect unless it is enacted by a three-fifths

24  vote of the membership of each house of the Legislature.

28    Creates the Shooting Range Cleanup Trust Fund within the
      Department of Environmental Protection. Provides for the
29    investment of moneys in the trust fund and the annual
      carryforward of funds. Provides for future legislative
