1 A bill to be entitled
2 An act relating to physical fitness and health;
3 establishing the Governor's Council for a Fit
4 Florida; providing powers and duties of the
5 council; providing for membership and terms;
6 providing for council meetings; requiring
7 members to serve without compensation;
8 providing for reimbursement for per diem and
9 travel expenses; requiring each county health
10 department to establish a county Council for a
11 Fit Florida; providing powers and duties of
12 such councils; providing for membership and
13 terms; providing for council meetings;
14 requiring members to serve without
15 compensation; providing for reimbursement for
16 per diem and travel expenses; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. (1) The Governor's Council for a Fit
22 Florida is established within the Department of Health. The
23 council shall have the following powers and duties to:
24 (a) Promote interest in the area of physical fitness;
25 to consider the need for new programs in the field of physical
26 fitness; to enlist the active support of individual citizens,
27 professional and civic groups, amateur and professional
28 athletes, voluntary organizations, state and local government
29 agencies, private industry and business, and community
30 recreation programs in efforts to improve the physical fitness
31 and the health of the citizens of this state.

1 (b) Examine current physical fitness programs
2 available to the people of this state and to make
3 recommendations to the Governor for coordination of programs
4 to prevent duplication of such services; to support physical
5 fitness programs in the public school system; to develop
6 cooperative programs with medical, dental, and other groups;
7 to maintain a liaison with government, private, and other
8 agencies, particularly the Department of Education, the
9 Department of Agriculture and Consumer Services, and the
10 Florida Sports Foundation concerning physical fitness
11 programs; to stimulate research in the area of physical
12 fitness; and to sponsor physical fitness workshops, clinics,
13 conferences, and other related activities pertaining to
14 physical fitness throughout the state.
15 (c) Recognize outstanding developments, contributions,
16 and achievements in physical fitness in this state by
17 individuals, schools, and communities.
18 (d) Enlist the active support of an alliance comprised
19 of individual citizens, professional and civic groups, amateur
20 and professional athletes, voluntary organizations, state and
21 local government agencies, private industry and business, and
22 community recreation programs in efforts to improve the
23 physical fitness and health of the citizens of the state.
24 (e) Sponsor physical fitness workshops, clinics,
25 conferences, and other related activities; to partner with
26 government, private, and other agencies concerning physical
27 fitness and nutrition programs; to disseminate information
28 regarding physical fitness and nutrition programs; and to
29 encourage the participation of government, individuals,
30 organizations, and business entities in program development,

1 support, and funding of initiatives relating to physical
2 fitness and nutrition efforts recommended by the council.
3 (f) Make an annual report to the Governor which shall
4 include suggestions and recommendations for the furtherance of
5 the physical fitness of the people of the state.
6 (2)(a) The council shall consist of 10 members,
7 including a chair. The council shall be composed of eight
8 members appointed by the Governor, one member appointed by the
9 President of the Senate, and one member appointed by the
10 Speaker of the House of Representatives, with the initial
11 appointments being made no later than September 1, 2004.
12 (b) When making appointments to the council the
13 Governor, the President of the Senate, and the Speaker of the
14 House of Representatives shall appoint persons from health
15 care professions, fields of business and industry, physical
16 education, recreation, sports, and the general public.
17 (c) Members of the council appointed by the President
18 of the Senate and the Speaker of the House of Representatives
19 shall be appointed for terms of 2 years each, beginning and
20 ending on July 1 of even-numbered years. Members of the
21 council appointed by the President of the Senate and the
22 Speaker of the House of Representatives shall serve no more
23 than two consecutive terms and shall serve at the pleasure of
24 the official who appointed the member to the council.
25 (d) The eight initial members of the council appointed
26 by the Governor shall be appointed as follows: two members for
27 a term of 1 year each, two members for terms of 2 years each,
28 two members for terms of 3 years each, and two members for
29 terms of 4 years each. At the end of the respective terms of
30 office of the initial members, all succeeding appointments
31 shall be for terms of 4 years. Members of the council

1 appointed by the Governor shall serve no more than two
2 consecutive 4-year terms and shall serve at the pleasure of
3 the Governor.
4 (e) All unexpired terms due to vacancy shall be filled
5 by the official who appointed the council member.
6 (f) The council shall annually elect from the
7 membership one member to serve as chair of the council and one
8 member to serve as vice chair.
9 (g) The council shall meet no more than quarterly and
10 a majority of the members of the council shall constitute a
11 quorum for the transaction of business.
12 (h) Members of the council shall serve without
13 compensation but shall be entitled to reimbursement for per
14 diem and travel expenses as provided in section 112.061,
15 Florida Statutes, while in the performance of their duties.
16 Section 2. (1) Each county health department shall
17 establish a county Council for a Fit Florida. The council
18 shall have the following powers and duties to:
19 (a) Make recommendations to the local district school
20 board on school district policies regarding nutritional
21 offerings at schools, on school nutrition assessments, and on
22 improvements to nutritional standards.
23 (b) Make recommendations to the local district school
24 board on school district policies regarding physical activity
25 and fitness offerings at schools, on physical fitness
26 assessments, and on improvements to physical fitness
27 curriculum in the schools.
28 (c) Make recommendations on improving the general
29 wellness of the community in coordination with other local
30 governments, businesses, and not-for-profit organizations.

1 (2)(a) The council shall consist of 10 members,
2 including a chair and vice chair. The council shall be
3 composed of four members appointed by the local director of
4 the county health department, four members appointed by the
5 superintendent of schools, and two members appointed by the
6 chair of the board of county commissioners, with the initial
7 appointments being made no later than September 1, 2004.
8 (b) When making appointments to the council, the
9 department director, the superintendent and the chair shall
10 appoint persons from health care professions, fields of
11 business and industry, physical education, recreation, sports,
12 and the general public.
13 (c) Members of the council appointed by the
14 superintendent of schools and the chair of the board of county
15 commissioners shall be appointed for term of 2 years each,
16 beginning and ending on July 1 of even-numbered years. Members
17 of the council appointed by the superintendent of schools and
18 the chair of the board of county commissioners shall serve no
19 more than two consecutive terms and shall serve at the
20 pleasure of the official who appointed the member of the
21 council.
22 (d) The four initial members of the council appointed
23 by the county health department shall be appointed as follows:
24 one member for a term of 1 year, one member for a term of 2
25 years, one member for a term of 3 years, and one member for a
26 term of 4 years. At the end of the respective terms of office
27 of the initial members, all succeeding appointments shall be
28 for terms of 4 years. Members of the council appointed by the
29 director of the county health department shall serve no more
30 than two consecutive 4-year terms and shall serve at the
31 pleasure of the director of the county health department.
