  1                      A bill to be entitled

  2         An act relating to health care clinics;

  3         amending s. 400.991, F.S.; changing the date by

  4         which an initial application for a health care

  5         clinic license must be filed with the Agency

  6         for Health Care Administration; making

  7         conforming changes to the requirement that

  8         qualified applicants receive a temporary

  9         license; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsections (2) and (3) of section

14  400.991,Florida Statutes, are amended to read:

15         400.991  License requirements; background screenings;

16  prohibitions.--

17         (2)  The initial clinic license application shall be

18  filed with the agency by all clinics, as defined in s.

19  400.9905, on or before July 1 March 1, 2004. A clinic license

20  must be renewed biennially.

21         (3)  Applicants that submit an application on or before

22  July 1 March 1, 2004, which meets all requirements for initial

23  licensure as specified in this section shall receive a

24  temporary license until the completion of an initial

25  inspection verifying that the applicant meets all requirements

26  in rules authorized by s. 400.9925. However, a clinic engaged

27  in magnetic resonance imaging services may not receive a

28  temporary license unless it presents evidence satisfactory to

29  the agency that such clinic is making a good faith effort and

30  substantial progress in seeking accreditation required under

31  s. 400.9935.

 1         Section 2.  This act shall take effect upon becoming a

 2  law.
