1 A bill to be entitled
2 An act relating to Hillsborough County;
3 providing definitions; providing purpose;
4 authorizing purchases of goods and services by
5 the county and other public bodies operating in
6 the county under bids submitted to other
7 federal, state, and local governmental
8 entities; providing conditions; providing
9 construction; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. As used in this act:
14 (1) "Public body" means any entity created by the
15 Florida Constitution, by general or special law, or by
16 ordinance and operating within the geographic boundaries of
17 Hillsborough County.
18 (2) "Publicly advertised competitive sealed bidding
19 process" means a process of receiving two or more sealed bids
20 submitted by vendors in response to an invitation to bid made
21 available simultaneously to all vendors by publication in a
22 newspaper of general circulation. The invitation to bid must
23 include a detailed description of the goods and services
24 sought, the time and date for the receipt of bids and of the
25 public opening, and the contractual terms and conditions
26 applicable to the procurement, including the criteria to be
27 used in determining acceptability of the bid.
28 Section 2. The purpose of this act is to facilitate
29 the purchase of goods and services by a public body by
30 enabling a public body to engage in cooperative purchasing

1 practices with other federal, state, and local governmental
2 entities.
3 Section 3. A public body may purchase goods and
4 services under the terms of a bid submitted to and accepted by
5 any other federal, state, or local governmental entity and
6 under the terms of a contract with such other governmental
7 entity, provided that such bid or contract results from a
8 publicly advertised competitive sealed bidding process.
9 Section 4. Any cooperative purchase made under the
10 provisions of this act is exempt from the requirements for
11 advertising for bids and for competitive sealed bidding
12 otherwise applicable to such purchases, provided that the
13 governmental entity that acts as a purchasing partner to a
14 public body has complied with the requirements of a publicly
15 advertised competitive sealed bidding process.
16 Section 5. This act provides a supplemental,
17 additional, and alternative method of purchasing and is not in
18 derogation of any purchasing powers now existing, including
19 the powers provided for in chapter 69-1119, Laws of Florida.
20 Section 6. This act shall take effect upon becoming a
21 law.
