1 House Joint Resolution
2          A joint resolution proposing an amendment to Section 5 of
3    Article XI of the State Constitution to require that a
4    proposed amendment to or revision of the State
5    Constitution be approved by vote of 60 percent of the
6    voters of the state and 60 percent of the voters in each
7    of the congressional districts of the state voting on the
8    amendment or revision.

10          Be It Resolved by the Legislature of the State of Florida:
11         
12          That the amendment to Section 5 of Article XI of the State
13    Constitution set forth below is agreed to and shall be submitted
14    to the electors of Florida for approval or rejection at the
15    general election to be held in November 2004:

17 AMENDMENTS
18          SECTION 5. Amendment or revision election.--
19          (a) A proposed amendment to or revision of this
20    constitution, or any part of it, shall be submitted to the
21    electors at the next general election held more than ninety days
22    after the joint resolution, initiative petition or report of
23    revision commission, constitutional convention or taxation and
24    budget reform commission proposing it is filed with the
25    custodian of state records, unless, pursuant to law enacted by
26    the affirmative vote of three-fourths of the membership of each
27    house of the legislature and limited to a single amendment or
28    revision, it is submitted at an earlier special election held
29    more than ninety days after such filing.
30          (b) The legislature shall provide by general law, prior to
31    the holding of an election pursuant to this section, for the
32    provision of a statement to the public regarding the probable
33    financial impact of any amendment proposed by initiative
34    pursuant to section 3.
35          (c) Once in the tenth week, and once in the sixth week
36    immediately preceding the week in which the election is held,
37    the proposed amendment or revision, with notice of the date of
38    election at which it will be submitted to the electors, shall be
39    published in one newspaper of general circulation in each county
40    in which a newspaper is published.
41          (d) If the proposed amendment or revision is approved by
42    vote of 60 percent of the electors of the state and 60 percent
43    of the electors in each of the congressional districts of the
44    state voting on the amendment or revision, it shall be effective
45    as an amendment to or revision of the constitution of the state
46    on the first Tuesday after the first Monday in January following
47    the election, or on such other date as may be specified in the
48    amendment or revision.
49          BE IT FURTHER RESOLVED that the title and substance of the
50    amendment proposed herein shall appear on the ballot as follows:
51 VOTE REQUIRED TO AMEND OR REVISE STATE CONSTITUTION
52          Proposes an amendment to Section 5 of Article XI of the
53    State Constitution to require that a proposed amendment to or
54    revision of the State Constitution be approved by 60 percent of
55    the voters of the state and 60 percent of the voters in each of
56    the congressional districts of the state voting on the amendment
57    or revision.
