13 Senate Amendment (with title amendment)
14 On page 1, delete everything after the resolving clause
15
16 and insert:
17 That the following amendment to Section 10 of Article
18 IV and the following creation of Section 8 of Article XI of
19 the State Constitution is agreed to and shall be submitted to
20 the electors of this state for approval or rejection at the
21 next general election or at an earlier special election
22 specifically authorized by law for that purpose:
23 ARTICLE IV
24 EXECUTIVE
25 SECTION 10. Attorney General.--The attorney general
26 shall, as directed by general law, request the opinion of the
27 justices of the supreme court as to the validity of any
28 proposed amendment to or revision of this constitution
29 initiative petition circulated pursuant to Section 3 of
30 Article XI. The justices shall, subject to their rules of
31 procedure, permit interested persons to be heard on the

1 questions presented and shall render their written opinion
2 expeditiously.
3 ARTICLE XI
4 AMENDMENTS
5 SECTION 8. SUBJECT LIMITATION.--Any proposed amendment
6 to or revision of this constitution must:
7 (a) seek to alter, amend, or repeal an existing
8 article of or amendment to this constitution;
9 (b) address a basic right of a citizen of this state;
10 or
11 (c) change the basic structure of state government as
12 established in Article II, Article III, Article IV, or Article
13 V.
14 BE IT FURTHER RESOLVED that the following statement be
15 placed on the ballot:
16 CONSTITUTIONAL AMENDMENT
17 ARTICLE IV, SECTION 10
18 ARTICLE XI, SECTION 8
19 SUBJECT MATTER LIMITATIONS ON PROPOSED CONSTITUTIONAL
20 AMENDMENTS AND REVISIONS.--Proposing an amendment to the State
21 Constitution to provide that a constitutional amendment or
22 revision proposed in any manner must alter, amend, or repeal
23 an existing article or amendment to the State Constitution;
24 address a fundamental right of a citizen of this state; or,
25 change a basic structure of state government as established in
26 Article II, Article III, Article IV, or Article V; providing
27 for the Florida Supreme Court to review proposed
28 constitutional amendments or revisions to ensure that they
29 meet one of these criteria.

10 State Constitution; detailing the scope of permissible subject
11 matter for proposed amendments or revisions to the State
12 Constitution; authorizing the Florida Supreme Court to review
13 proposed amendments and revisions to ensure that they meet the
14 subject matter requirement.
