14 On page 7, lines 17-29, delete those lines

16 and insert:
17 Section 2. Subsection (2) and paragraphs (f), (i), and
18 (j) of subsection (3) of section 20.43, Florida Statutes, are
19 amended, and paragraph (k) is added to that subsection, to
20 read:
21 20.43 Department of Health.--There is created a
22 Department of Health.
23 (2)(a) The head of the Department of Health is the
24 Secretary of Health and State Health Officer. The secretary
25 must be a physician licensed under chapter 458 or chapter 459
26 who has advanced training or extensive experience in public
27 health administration. The secretary is appointed by the
28 Governor subject to confirmation by the Senate. The secretary
29 serves at the pleasure of the Governor.
30 (b) The Officer of Women's Health Strategy is
31 established within the Department of Health and shall report

1 directly to the secretary.
2 (3) The following divisions of the Department of
3 Health are established:
4 (f) Division of Emergency Medical Operations Services
5 and Community Health Resources.
6 (i) Division of Information Technology Resource
7 Management.
8 (j) Division of Health Access Awareness and Tobacco.
9 (k) Division of Disability Determinations.
10 Section 3. Section 381.04015, Florida Statutes, is
11 created to read:
12 381.04015 Women's Health Strategy; legislative intent;
13 duties of Officer of Women's Health Strategy; other state
14 agency duties.--
15 (1) LEGISLATIVE INTENT.--The Legislature recognizes
16 that the health care needs of women are gender-specific and
17 that public policy must take into account the distinct
18 characteristics of women's health issues. Priority shall be
19 given to improve the overall health status of women through
20 research and education on women's health issues. The
21 Legislature recognizes the importance of understanding why
22 there are such large differences between how women and men
23 experience certain diseases and also recognizes that
24 biomedical research is the key to finding these answers. Such
25 research has important implications for both women and men in
26 terms of clinical practice and disease prevention and
27 manifestation. The Legislature recognizes that as the state's
28 population continues to age and life expectancy for women
29 continues to rise, it is of the utmost importance for the
30 Legislature to encourage effective medical research on
31 long-term health issues for women and to educate elder women

1 about the importance of participating in medical studies. The
2 Legislature finds and declares that the design and delivery of
3 health care services and the medical education of health care
4 practitioners shall be directed by the principle that health
5 care needs are gender-specific.
6 (2) DUTIES.--The Officer of Women's Health Strategy in
7 the Department of Health shall:
8 (a) Ensure that the state's policies and programs are
9 responsive to sex and gender differences and to women's health
10 needs across the life span.
11 (b) Organize an interagency Committee for Women's
12 Health for the purpose of integrating women's health programs
13 in current operating and service delivery structures and
14 setting priorities for women's health. This committee shall be
15 comprised of the heads or directors of state agencies with
16 programs affecting women's health, including, but not limited
17 to, the Department of Health, the Agency for Health Care
18 Administration, the Department of Education, the Department of
19 Elderly Affairs, the Department of Corrections, the Office of
20 Insurance Regulation of the Department of Financial Services,
21 and the Department of Juvenile Justice.
22 (c) Assess the health status of women in the state
23 through the collection and review of health data and trends.
24 (d) Review the state's insurance code as it relates to
25 women's health issues.
26 (e) Work with medical school curriculum committees to
27 develop course requirements on women's health and promote
28 clinical practice guidelines specific to women.
29 (f) Organize statewide Women's Health Month
30 activities.
31 (g) Coordinate a Governor's statewide conference on

1 women's health, cosponsored by the agencies participating in
2 the Committee for Women's Health and other private
3 organizations and entities impacting women's health in the
4 state.
5 (h) Promote research, treatment, and collaboration on
6 women's health issues at universities and medical centers in
7 the state.
8 (i) Promote employer incentives for wellness programs
9 targeting women's health programs.
10 (j) Serve as the primary state resource for women's
11 health information.
12 (k) Develop a statewide women's health plan
13 emphasizing collaborative approaches to meeting the health
14 needs of women. The plan shall:
15 1. Identify activities designed to reduce the number
16 of premature deaths in women, including:
17 a. Providing specific strategies for reducing the
18 mortality rate of women.
19 b. Listing conditions that may cause or contribute to
20 disease in women and the best methods by which to identify,
21 control, and prevent these conditions from developing.
22 c. Identifying the best methods for ensuring an
23 increase in the percentage of women in the state who receive
24 diagnostic and screening testing.
25 2. Provide for increasing research and appropriate
26 funding at institutions in the state studying disease in
27 women.
28 3. Provide recommendations for the development of
29 practice guidelines for addressing disease in women.
30 4. Provide recommendations for reducing health
31 disparities among women in all races and ethnic groups.

1 5. Coordinate with existing program plans that address
2 women's health issues.
3 (l) Promote clinical practice guidelines specific to
4 women.
5 (m) Serve as the state's liaison with other states and
6 federal agencies and programs to develop best practices in
7 women's health.
8 (n) Develop a statewide, web-based clearinghouse on
9 women's health issues and resources.
10 (o) Promote public awareness campaigns and education
11 on the health needs of women.
12 (p) By January 15 of each year, provide the Governor,
13 the President of the Senate, and the Speaker of the House of
14 Representatives a report with policy recommendations for
15 implementing the provisions of this section.
16 (3) DUTIES OF OTHER STATE AGENCIES.--
17 (a) Women's health issues shall be taken into
18 consideration in the annual budget planning of the Department
19 of Health, the Agency for Health Care Administration, and the
20 Department of Elderly Affairs.
21 (b) The inclusion of gender considerations and
22 differential impact shall be one of the criteria when
23 assessing research and demonstration proposals for which state
24 funding is being sought from the Department of Health, the
25 Agency for Health Care Administration, and the Department of
26 Elderly Affairs.
27 (c) Boards or advisory bodies that fall under the
28 purview of the Department of Health, the Agency for Health
29 Care Administration, and the Department of Elderly Affairs
30 shall be encouraged to seek equal representation of women and
31 men and the inclusion of persons who are knowledgeable and

1 sensitive to gender and diversity issues.
2 (4) RESPONSIBILITY AND COORDINATION.--The officer and
3 the department shall direct and carry out the Women's Health
4 Strategy established under this section in accordance with the
5 requirements of this section and may work with the Executive
6 Office of the Governor and other state agencies to carry out
7 their duties and responsibilities under this section.
8 Section 4. Effective July 1, 2004, there is
9 appropriated the sum of $150,000 from the General Revenue
10 Fund, and one full-time equivalent position is authorized, for
11 the Department of Health to implement the establishment of the
12 Officer of Women's Health Strategy by this act.
