  1                      A bill to be entitled

  2         An act relating to penny-ante games; amending

  3         s. 849.085, F.S.; exempting the conduct of

  4         penny-ante games in described facilities from a

  5         prohibition against soliciting participants

  6         through advertising; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Paragraph (d) of subsection (3) of section

12  849.085, Florida Statutes, is amended to read:

13         849.085  Certain penny-ante games not crimes;

14  restrictions.--

15         (3)  A penny-ante game is subject to the following

16  restrictions:

17         (d)  A person may not solicit participants by means of

18  advertising in any form, advertise the time or place of any

19  penny-ante game, except for posting a notice at the dwelling

20  or distributing notice to residents or members of the entity

21  owning the dwelling, or advertise the fact that he or she will

22  be a participant in any penny-ante game.

23         Section 2.  This act shall take effect upon becoming a

24  law.

26          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
27                         Senate Bill 2474

29  The committee substitute provides that the exemption to the
    prohibition on advertising the time and place of a penny-ante
30  game shall be allowed for the posting of a notice at the
    dwelling or distributing notice to residents or members of the
31  entity owning the dwelling.
