13         Senate Amendment (with title amendment) 
14         On page 43, line 20,
15  
16  insert:  
17         Section 41.  In order to implement Sections 1 through 6
18  of the 2004-2005 General Appropriations Act:
19         (1)  Each state contract for the performance of
20  services entered into during the 2004-2005 fiscal year by an
21  agency, as defined in section 216.011(1)(qq), Florida
22  Statutes, must specify that only Florida residents may be
23  employed to perform services under the contract or any
24  subcontract under the contract. The Governor and Cabinet may
25  grant an exception only to allow contracted services to be
26  provided by employees outside Florida but within the United
27  States if it is determined, during a public hearing, that it
28  is in the best interest of Floridians that all or part of the
29  contract for services be performed outside of Florida.
30         (2)  The Department of Management Services shall
31  produce a monthly report, listing each state contract and

The report must include the 3 fiscal amount of each contract, the name and address of the 4 vendor, and a detailed accounting, by municipality and state, 5 of the number of contracted employees located in and outside 6 Florida. 7 (3) If a contractor or subcontractor is found to be in 8 violation of the state contract for the performance of 9 services with regard to the residence of employees, as 10 provided in this section, the contractor or subcontractor, and 11 its principals, shall be deemed ineligible to receive any 12 state contract, grant, or incentive funding for a seven-year 13 period. 14 (4) This section may be referred to by the popular 15 name the "Florida's Money, Florida Jobs Amendment." 16 (5) The Department of Management Services shall adopt 17 rules to administer this section. 18 (6) This section expires July 1, 2005. 19 20 21 ================ T I T L E A M E N D M E N T =============== 22 And the title is amended as follows: 23 On page 5, line 3,after the semicolon delete 24 25 and insert: 26 creates the Florida's Money, Florida Jobs 27 Amendment; requiring state agency contracts to 28 specify that only Florida residents may be 29 employed by contractors and subcontractors; 30 providing an exception; requiring the 31 Department of Management Services to produce a 2 11:17 AM 03/30/04 s2502.ap32.01
