1 A bill to be entitled
2 An act relating to the distribution of proceeds
3 from the excise tax on documents; amending s.
4 201.15, F.S.; requiring that any proceeds of
5 the tax in excess of the amount appropriated in
6 the 2003-2004 fiscal year be deposited into the
7 General Revenue Fund rather than appropriated
8 as otherwise provided by law; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (15) is added to section 201.15,
14 Florida Statutes, to read:
15 201.15 Distribution of taxes collected.--All taxes
16 collected under this chapter shall be distributed as follows
17 and shall be subject to the service charge imposed in s.
18 215.20(1), except that such service charge shall not be levied
19 against any portion of taxes pledged to debt service on bonds
20 to the extent that the amount of the service charge is
21 required to pay any amounts relating to the bonds:
22 (15) Notwithstanding the distribution of taxes
23 calculated pursuant to subsections (2), (3), (4), (5), (6),
24 (7), (8), (9), and (10), the amounts distributed pursuant to
25 these subsections for any fiscal year may not exceed the
26 amounts appropriated in section 5 of chapter 2003-397, Laws of
27 Florida, the General Appropriations Act for the 2003-2004
28 fiscal year. Calculated distributions in excess of the amounts
29 appropriated in chapter 2003-397, Laws of Florida, the General
30 Appropriations Act for the 2003-2004 fiscal year, shall be
31 paid into the State Treasury to the credit of the General

1 Revenue Fund of the state to be used and expended for the
2 purposes for which the General Revenue Fund was created and
3 exists by law.
4 Section 2. This act shall take effect July 1, 2005.

6 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
7 SB 2514

9 The committee substitute makes it clear which distributions
from documentary stamp tax revenue are affected by the bill
10 and the maximum amounts which may be distributed to the
various trust funds receiving doc stamp tax.
