9 | Section 7. The Legislature shall conduct an interim study |
10 | of the issues surrounding antiquated subdivisions and suggest |
11 | statutory and nonstatutory mechanisms and incentives to promote |
12 | the redevelopment of antiquated subdivisions in a manner |
13 | designed to meet current planning and environmental standards |
14 | and promote the marketability of such redesigned communities. |
15 | Any proposals must recognize and maintain the property rights of |
16 | all property owners in order to provide certainty to property |
17 | owners regarding the manner in which property rights will be |
18 | maintained while redevelopment is encouraged and promoted. For |
19 | the purposes of the study, "antiquated subdivision" is defined |
20 | as a residential subdivision of more than 500 lots, created |
21 | prior to 1980, in which little actual residential development |
22 | has occurred and in which the vast majority of the property is |
23 | vacant and not in productive use. |
24 | Section 8. This act shall take effect upon becoming a law. |

41 | WHEREAS, under the Constitution of the State of Florida all |
42 | natural persons have inalienable rights, among which are the |
43 | right to acquire, possess, and protect property, and |
44 | WHEREAS, no person shall be deprived of property without |
45 | due process of law, and |
46 | WHEREAS, Florida's population growth has resulted in an |
47 | increased need for well-planned mixed-use communities, and |
48 | WHEREAS, many communities in Florida contain antiquated |
49 | subdivisions which have failed to develop due to failing |
50 | infrastructure and lack of services, and |
51 | WHEREAS, such antiquated subdivisions are an economic |
52 | liability to their property owners and the communities in which |
53 | they exist, and |
54 | WHEREAS, additional tools are needed to provide the |
55 | necessary incentives and mechanisms to promote the redevelopment |
56 | of such antiquated subdivisions into communities which meet both |
57 | modern standards for land planning and marketability, and |
58 | WHEREAS, any such incentives and mechanisms must recognize |
59 | and maintain existing property rights, NOW, THEREFORE, |
