9     Section 7.  The Legislature shall conduct an interim study
10of the issues surrounding antiquated subdivisions and suggest
11statutory and nonstatutory mechanisms and incentives to promote
12the redevelopment of antiquated subdivisions in a manner
13designed to meet current planning and environmental standards
14and promote the marketability of such redesigned communities.
15Any proposals must recognize and maintain the property rights of
16all property owners in order to provide certainty to property
17owners regarding the manner in which property rights will be
18maintained while redevelopment is encouraged and promoted. For
19the purposes of the study, "antiquated subdivision" is defined
20as a residential subdivision of more than 500 lots, created
21prior to 1980, in which little actual residential development
22has occurred and in which the vast majority of the property is
23vacant and not in productive use.
24     Section 8.  This act shall take effect upon becoming a law.

41     WHEREAS, under the Constitution of the State of Florida all
42natural persons have inalienable rights, among which are the
43right to acquire, possess, and protect property, and
44     WHEREAS, no person shall be deprived of property without
45due process of law, and
46     WHEREAS, Florida's population growth has resulted in an
47increased need for well-planned mixed-use communities, and
48     WHEREAS, many communities in Florida contain antiquated
49subdivisions which have failed to develop due to failing
50infrastructure and lack of services, and
51     WHEREAS, such antiquated subdivisions are an economic
52liability to their property owners and the communities in which
53they exist, and
54     WHEREAS, additional tools are needed to provide the
55necessary incentives and mechanisms to promote the redevelopment
56of such antiquated subdivisions into communities which meet both
57modern standards for land planning and marketability, and
58     WHEREAS, any such incentives and mechanisms must recognize
59and maintain existing property rights, NOW, THEREFORE,
