| 2 | An act relating to traffic; amending s. 316.006, F.S.; | ||

| 4 | to regulate commercial vehicle traffic; providing an | ||

| 7 | Be It Enacted by the Legislature of the State of Florida: | ||
| 8 | |||
| 9 | Section 1. Paragraph (c) is added to subsection (2) of | ||
| 10 | section 316.006, Florida Statutes, to read: | ||
| 11 | 316.006 Jurisdiction.--Jurisdiction to control traffic is | ||
| 12 | vested as follows: | ||
| 13 | (2) MUNICIPALITIES.-- | ||
| 14 | (c) Municipalities shall have jurisdiction and authority | ||
| 15 | to regulate and restrict commercial vehicle traffic over all | ||
| 16 | streets and highways located within their boundaries by granting | ||
| 17 | permits, franchises, and licenses or by otherwise exercising | ||
| 18 | such authority. The purpose of this paragraph is to reinforce | ||
| 19 | the long-standing policy of this state. | ||

| 21 | This subsection shall not limit those counties which have the | ||
| 22 | charter powers to provide and regulate arterial, toll, and other | ||
| 23 | roads, bridges, tunnels, and related facilities from the proper | ||
| 24 | exercise of those powers by the placement and maintenance of | ||
| 25 | traffic control devices which conform to the manual and | ||
| 26 | specifications of the Department of Transportation on streets | ||
| 27 | and highways located within municipal boundaries. | ||
| 28 | Section 2. This act shall take effect upon becoming a law. | ||
