10 | that no liability arises for municipalities for exercising |
11 | their rights to regulate sightseeing operations; providing |
12 | an effective date. |

14 | Be It Enacted by the Legislature of the State of Florida: |

16 | Section 1. Paragraph (c) is added to subsection (2) of |
17 | section 316.006, Florida Statutes, to read: |
18 | 316.006 Jurisdiction.--Jurisdiction to control traffic is |
19 | vested as follows: |
20 | (2) MUNICIPALITIES.-- |
21 | (c) Without limiting, modifying, or restricting any other |
22 | statutory, contractual, or common law municipal powers, the |
23 | Legislature expressly reaffirms the policy of this state that |
24 | municipalities may grant permits, licenses, or franchises or may |
25 | otherwise regulate sightseeing operations on public rights-of- |
26 | way within their jurisdictions. This paragraph is solely |
27 | intended to clarify that liability does not arise for |
28 | municipalities or their permittees, licensees, or franchisees |
29 | under chapter 542 for regulating sightseeing operations as |
30 | described in this paragraph. |

32 | This subsection shall not limit those counties which have the |
33 | charter powers to provide and regulate arterial, toll, and other |
34 | roads, bridges, tunnels, and related facilities from the proper |
35 | exercise of those powers by the placement and maintenance of |
36 | traffic control devices which conform to the manual and |
37 | specifications of the Department of Transportation on streets |
38 | and highways located within municipal boundaries. |
39 | Section 2. This act shall take effect upon becoming a law. |
