6An act relating to traffic control; amending s. 316.006,
7F.S.; providing for jurisdiction and authority of
8municipalities to grant permits, licenses, or franchises
9or otherwise regulate sightseeing operations; specifying
10that no liability arises for municipalities for exercising
11their rights to regulate sightseeing operations; providing
12an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Paragraph (c) is added to subsection (2) of
17section 316.006, Florida Statutes, to read:
18     316.006  Jurisdiction.--Jurisdiction to control traffic is
19vested as follows:
20     (2)  MUNICIPALITIES.--
21     (c)  Without limiting, modifying, or restricting any other
22statutory, contractual, or common law municipal powers, the
23Legislature expressly reaffirms the policy of this state that
24municipalities may grant permits, licenses, or franchises or may
25otherwise regulate sightseeing operations on public rights-of-
26way within their jurisdictions. This paragraph is solely
27intended to clarify that liability does not arise for
28municipalities or their permittees, licensees, or franchisees
29under chapter 542 for regulating sightseeing operations as
30described in this paragraph.

32This subsection shall not limit those counties which have the
33charter powers to provide and regulate arterial, toll, and other
34roads, bridges, tunnels, and related facilities from the proper
35exercise of those powers by the placement and maintenance of
36traffic control devices which conform to the manual and
37specifications of the Department of Transportation on streets
38and highways located within municipal boundaries.
39     Section 2.  This act shall take effect upon becoming a law.
