  1                      A bill to be entitled

  2         An act relating to license plates; amending ss.

  3         320.08056 and 320.08058, F.S.; creating an

  4         Adopt A Best Friend license plate and a Florida

  5         National Guard license plate; providing for the

  6         distribution of annual use fees received from

  7         the sale of such plates; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraphs (ss) and (tt) are added to

13  subsection (4) of section 320.08056, Florida Statutes, to

14  read:

15         320.08056  Specialty license plates.--

16         (4)  The following license plate annual use fees shall

17  be collected for the appropriate specialty license plates:

18         (ss)  Adopt A Best Friend license plate, $25.

19         (tt)  Florida National Guard license plate, $25.

20         Section 2.  Subsections (45) and (46) are added to

21  section 320.08058, Florida Statutes, to read:

22         320.08058  Specialty license plates.--

23         (45)  ADOPT A BEST FRIEND LICENSE PLATES.--

24         (a)  Notwithstanding s. 320.08053, the department shall

25  develop an Adopt A Best Friend license plate as provided in

26  this section. The word "Florida" must appear at the top of the

27  plate, and the words "Adopt A Best Friend" must appear at the

28  bottom of the plate.

29         (b)  The department shall retain initial annual use fee

30  proceeds sufficient to cover its costs related to the

31  development and issuance of the Adopt A Best Friend license

 1  plate, not to exceed $60,000. Thereafter, the proceeds of the

 2  annual use fees shall be distributed to the Florida No More

 3  Homeless Pets Association, Inc., to help make Florida a no

 4  more homeless pets state. Twenty-five percent of the funds

 5  received by the Florida No More Homeless Pets Association,

 6  Inc., shall be expended for promotion, marketing, and

 7  administration of the license plate.

 8         (46)  FLORIDA NATIONAL GUARD LICENSE PLATES.--

 9         (a)  Notwithstanding the provisions of s. 320.08053,

10  the department shall develop a Florida National Guard license

11  plate as provided in this section. The word "Florida" must

12  appear at the top of the plate, and the words "National Guard"

13  must appear at the bottom of the plate.

14         (b)  The department shall retain all annual use fee

15  revenues from the sale of such plates until all startup costs

16  for developing and issuing the plates are recovered, not to

17  exceed $60,000. Thereafter the annual use fees shall be

18  distributed to the Florida National Guard Foundation.

19         Section 3.  This act shall take effect July 1, 2004.

24  The CS adds the creation of an Adopt A Best Friend specialty
    license plate to the bill and provides for a $25 annual use
25  fee with the proceeds distributed to the Florida No More
    Homeless Pets Association, Inc., to address the problem of
26  homeless pets in Florida.

27  The CS revises the distribution of proceeds from the Florida
    National Guard specialty license plate to provide that all
28  funds must be distributed to the Florida National Guard
    Foundation.

    The CS also provides that DHSMV shall retain initial proceeds
30  from the sale of the Florida National Guard license plate
    until all startup costs for developing and issuing the plates
31  are recovered, not to exceed $60,000.
