  1                      A bill to be entitled

  2         An act relating to Medicaid copayments;

  3         amending s. 409.9081, F.S.; deleting a

  4         copayment requirement for transportation

  5         services used by recipients; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (2) of section 409.9081, Florida

11  Statutes, is amended to read:

12         409.9081  Copayments.--

13         (2)  The agency shall, subject to federal regulations

14  and any directions or limitations provided for in the General

15  Appropriations Act, require copayments for the following

16  additional services:  hospital inpatient, laboratory and X-ray

17  services, transportation services, home health care services,

18  community mental health services, rural health services,

19  federally qualified health clinic services, and nurse

20  practitioner services. The agency may only establish

21  copayments for prescribed drugs or for any other federally

22  authorized service if such copayment is specifically provided

23  for in the General Appropriations Act or other law.

24         Section 2.  This act shall take effect July 1, 2004.
