489.117, F.S.; specifying conditions under which a person |

may perform specialty contracting services for the |

construction, remodeling, repair, or improvement of a |

swimming pool or spa without obtaining a local |

|
professional license; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

Section 1. Paragraph (f) is added to subsection (4) of |
12
|
section 489.117, Florida Statutes, to read: |

|
489.117 Registration; specialty contractors.-- |

|

(f) Any person who is not required to obtain registration |
16
|
or certification pursuant to s. 489.105(3)(a)-(i) or (m)-(o) may |
17
|
perform specialty contracting services for the construction, |
18
|
remodeling, repair, or improvement of a swimming pool or spa as |
19
|
specified in s. 489.105(3)(j)-(l) without obtaining a local |
20
|
professional license if such person is under the supervision of |
21
|
a certified or registered commercial pool/spa contractor, |
22
|
residential pool/spa contractor, or swimming pool/spa servicing |
23
|
contractor acting within the scope of his or her license. As |
24
|
used in this paragraph, supervision shall not be deemed to |
25
|
require the existence of a direct contract between the certified |
26
|
or registered contractor and the person performing specialty |
27
|
contracting services.

Section 2. This act shall take effect July 1, 2004. |
