1 A bill to be entitled
2 An act relating to specialty license plates;
3 amending s. 320.08053, F.S.; requiring
4 sponsoring organizations of proposed specialty
5 license plates to obtain advance deposits from
6 5,000 purchasers; providing for the handling
7 and disposition of such funds; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (b) of subsection (1) of section
13 320.08053, Florida Statutes, is amended to read:
14 320.08053 Requirements for requests to establish
15 specialty license plates.--
16 (1) An organization that seeks authorization to
17 establish a new specialty license plate for which an annual
18 use fee is to be charged must submit to the department:
19 (b) Proof that at least 5,000 motor vehicle owners
20 have prepaid for the proposed license plate. Payments received
21 by the organization must be placed in an escrow account. If
22 the proposed license plate is approved by the Legislature, the
23 funds shall be transferred to the department and persons who
24 have made the advance payment may then apply to the department
25 for the specialty license plate on forms prescribed by the
26 department, providing a receipt issued by the organization as
27 proof of payment. If the proposed specialty license plate is
28 not approved by the Legislature, the organization shall issue
29 refunds for the full amount of such prepayments. The results
30 of a scientific sample survey of Florida motor vehicle owners
31 that indicates at least 15,000 motor vehicle owners intend to

1 purchase the proposed specialty license plate at the increased
2 cost. The sample survey of registered motor vehicle owners
3 must be performed independently of the requesting organization
4 by an organization that conducts similar sample surveys as a
5 normal course of business. Prior to conducting a sample survey
6 for the purposes of this section, a requesting organization
7 must obtain a determination from the department that the
8 organization selected to conduct the survey performs similar
9 surveys as a normal course of business and is independent of
10 the requesting organization.

12 The information required under this subsection must be
13 submitted to the department at least 90 days before the
14 convening of the next regular session of the Legislature.
15 Section 2. This act shall take effect July 1, 2004.

19 Requires sponsoring organizations of proposed specialty
license plates to obtain advance deposits from 5,000
20 purchasers in order to apply for authorization to have
such plates issued.
