1 A bill to be entitled
2 An act relating to the State Homeland Security
3 Trust Fund; creating s. 288.833, F.S.; creating
4 the State Homeland Security Trust Fund, to be
5 administered by the Department of Law
6 Enforcement; providing for sources of funds and
7 purposes; providing for annual carry-forward of
8 unused funds; providing for review and
9 termination or re-creation of the trust fund;
10 providing a contingent effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 288.833, Florida Statutes, is
15 created to read:
16 288.833 State Homeland Security Trust Fund.--
17 (1) There is created the State Homeland Security Trust
18 Fund, to be administered by the Department of Law
19 Enforcement. Funds shall be credited to the trust fund as
20 provided in s. 288.857(4)(c), to be used for the purposes of
21 the "Florida Commerce With Terrorist States Act" as set forth
22 in s. 288.857.
23 (2) Notwithstanding the provisions of s. 216.301 and
24 pursuant to s. 216.351, any balance in the trust fund at the
25 end of any fiscal year shall remain in the trust fund at the
26 end of the year and shall be available for carrying out the
27 purposes of the trust fund.
28 (3) In accordance with s. 19(f)(2), Art. III of the
29 State Constitution, the State Homeland Security Trust Fund
30 shall be terminated on July 1, 2008, unless terminated

1 sooner. Before its scheduled termination, the trust fund
2 shall be reviewed as provided in s. 215.3206(1) and (2).
3 Section 2. This act shall take effect July 1, 2004, if
4 Senate Bill _____ or similar legislation creating the Florida
5 Commerce With Terrorist States Act is adopted in the same
6 legislative session or an extension thereof and becomes law.
