1 A bill to be entitled
2 An act relating to the State Homeland Security
3 Trust Fund; creating s. 288.833, F.S.; creating
4 the State Homeland Security Trust Fund, to be
5 administered by the Department of Emergency
6 Management; providing for sources of funds and
7 purposes; providing for review of requests for
8 funding; providing for annual carry-forward of
9 unused funds; providing for review and
10 termination or re-creation of the trust fund;
11 providing a contingent effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 288.833, Florida Statutes, is
16 created to read:
17 288.833 State Homeland Security Trust Fund.--
18 (1) There is created the State Homeland Security Trust
19 Fund, to be administered by the Department of Emergency
20 Management. Funds shall be credited to the trust fund as
21 provided in s. 288.857(4)(c), to be used to fund state
22 homeland security with priorities for funding to focus on
23 expenditures not funded by the Federal Government, such as
24 operational costs of security at seaports and other venues.
25 Requests for funding shall be reviewed by the Domestic
26 Security Oversight Board, which shall provide recommended
27 funding priorities.
28 (2) Notwithstanding the provisions of s. 216.301 and
29 pursuant to s. 216.351, any balance in the trust fund at the
30 end of any fiscal year shall remain in the trust fund at the

1 end of the year and shall be available for carrying out the
2 purposes of the trust fund.
3 (3) In accordance with s. 19(f)(2), Art. III of the
4 State Constitution, the State Homeland Security Trust Fund
5 shall be terminated on July 1, 2008, unless terminated
6 sooner. Before its scheduled termination, the trust fund
7 shall be reviewed as provided in s. 215.3206(1) and (2).
8 Section 2. This act shall take effect July 1, 2004, if
9 Senate Bill 2614, or similar legislation creating the Florida
10 Commerce With Terrorist States Act, is adopted in the same
11 legislative session or an extension thereof and becomes law.

16 Provides that the trust fund created by the bill must be
administered by the Department of Emergency Management.

Provides that funds transferred to the trust fund must be used
