1 A bill to be entitled
2 An act relating to the carrying of concealed
3 weapons; amending s. 790.06, F.S.; prohibiting
4 the carrying of a concealed weapon or firearm
5 into a district legislative office or within
6 the Capitol Complex; providing an exemption
7 from such prohibition for members of the
8 Legislature and Cabinet officers; providing a
9 penalty; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (12) of section 790.06, Florida
14 Statutes, is amended to read:
15 790.06 License to carry concealed weapon or firearm.--
16 (12) No license issued pursuant to this section shall
17 authorize any person to carry a concealed weapon or firearm
18 into any place of nuisance as defined in s. 823.05; any
19 police, sheriff, or highway patrol station; any detention
20 facility, prison, or jail; any courthouse; any courtroom,
21 except that nothing in this section would preclude a judge
22 from carrying a concealed weapon or determining who will carry
23 a concealed weapon in his or her courtroom; any polling place;
24 any meeting of the governing body of a county, public school
25 district, municipality, or special district; any meeting of
26 the Legislature or a committee thereof; any district office of
27 a member of the Legislature; any area of the Capitol Complex
28 as defined in s. 281.01, except that nothing in this section
29 would preclude a member of the Legislature or a Cabinet
30 officer from carrying a concealed weapon; any school, college,
31 or professional athletic event not related to firearms; any

1 school administration building; any portion of an
2 establishment licensed to dispense alcoholic beverages for
3 consumption on the premises, which portion of the
4 establishment is primarily devoted to such purpose; any
5 elementary or secondary school facility; any area technical
6 center; any college or university facility unless the licensee
7 is a registered student, employee, or faculty member of such
8 college or university and the weapon is a stun gun or
9 nonlethal electric weapon or device designed solely for
10 defensive purposes and the weapon does not fire a dart or
11 projectile; inside the passenger terminal and sterile area of
12 any airport, provided that no person shall be prohibited from
13 carrying any legal firearm into the terminal, which firearm is
14 encased for shipment for purposes of checking such firearm as
15 baggage to be lawfully transported on any aircraft; or any
16 place where the carrying of firearms is prohibited by federal
17 law. Any person who willfully violates any provision of this
18 subsection commits a misdemeanor of the second degree,
19 punishable as provided in s. 775.082 or s. 775.083.
20 Section 2. This act shall take effect July 1, 2004.

23 SENATE SUMMARY
24 Provides that it is a second-degree misdemeanor to carry
a concealed weapon or firearm into a district legislative
25 office or the Capital Complex. Exempts members of the
Legislature and Cabinet officers from such prohibition.
