1 A bill to be entitled
2 An act relating to the carrying of concealed
3 weapons; amending s. 790.06, F.S.; prohibiting
4 the carrying of a concealed weapon or firearm
5 within district legislative offices; within the
6 Capitol Building and specified surrounding
7 buildings and in certain adjacent areas;
8 providing an exemption for secured weapons or
9 firearms in vehicles parked within a parking
10 garage attached to any of the specified
11 buildings, or in a manner designated by the
12 Capitol Police; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (12) of section 790.06, Florida
17 Statutes, is amended to read:
18 790.06 License to carry concealed weapon or firearm.--
19 (12) No license issued pursuant to this section shall
20 authorize any person to carry a concealed weapon or firearm
21 into any place of nuisance as defined in s. 823.05; any
22 police, sheriff, or highway patrol station; any detention
23 facility, prison, or jail; any courthouse; any courtroom,
24 except that nothing in this section would preclude a judge
25 from carrying a concealed weapon or determining who will carry
26 a concealed weapon in his or her courtroom; any polling place;
27 any meeting of the governing body of a county, public school
28 district, municipality, or special district; any meeting of
29 the Legislature or a committee thereof; the district
30 legislative office of any state legislator, if notice is
31 posted in such a manner as to advise the public; anywhere

1 within the Capitol, the steps leading to the Capitol, the
2 Historic Capitol, the steps leading to the Historic Capitol,
3 the Senate Office Building, the House Office Building, the
4 Knott Building, or a parking garage attached to the Capitol,
5 the Historic Capitol, the Senate Office Building, the House
6 Office Building, or the Knott Building, except that nothing in
7 this section would preclude a person licensed to carry a
8 concealed weapon or firearm from securing the weapon or
9 firearm in his or her vehicle in a parking garage attached to
10 any of those buildings, or in a convenient manner designated
11 by the Capitol Police; any school, college, or professional
12 athletic event not related to firearms; any school
13 administration building; any portion of an establishment
14 licensed to dispense alcoholic beverages for consumption on
15 the premises, which portion of the establishment is primarily
16 devoted to such purpose; any elementary or secondary school
17 facility; any area technical center; any college or university
18 facility unless the licensee is a registered student,
19 employee, or faculty member of such college or university and
20 the weapon is a stun gun or nonlethal electric weapon or
21 device designed solely for defensive purposes and the weapon
22 does not fire a dart or projectile; inside the passenger
23 terminal and sterile area of any airport, provided that no
24 person shall be prohibited from carrying any legal firearm
25 into the terminal, which firearm is encased for shipment for
26 purposes of checking such firearm as baggage to be lawfully
27 transported on any aircraft; or any place where the carrying
28 of firearms is prohibited by federal law. Any person who
29 willfully violates any provision of this subsection commits a
30 misdemeanor of the second degree, punishable as provided in s.
31 775.082 or s. 775.083.

1 Section 2. This act shall take effect July 1, 2004.

3 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
4 Senate Bill 2654

6 - The CS narrows the list of places within the Capitol
Complex affected by the bill.
7
- The CS removes the language that had exempted legislators
8 and cabinet officers from the prohibition against
carrying a concealed weapon or firearm in the bill.
9
- Legislator's district offices must be posted to give the
10 public notice if the member elects to prohibit the
carrying of concealed weapons or firearms on the
11 premises.
12 - The CS provides for a person licensed to carry a
concealed weapon or firearm to secure the weapon or
13 firearm either in their vehicle in a parking garage
attached to one of the buildings listed in the CS, or
14 with Capitol Police in a location that is convenient to
the public.
