11  The Committee on Criminal Justice recommended the following
12  amendment:

16            page 8, line 18, delete those lines

18  and insert:  
19         (1)(a)  A person may not knowingly operate a vessel, or
20  authorize the operation of a vessel, in violation of the
21  restrictions of a safety zone, security zone, regulated
22  navigation area, or naval vessel protection zone as defined in
23  and established pursuant to 33 C.F.R. part 165.
24         (b)  The intent of this section is to provide for state
25  and local law enforcement agencies to operate in federally
26  designated exclusion zones specified in paragraph (a). State
27  and local law enforcement personnel may enforce these zones at
28  the request of a federal authority if necessary to augment
29  federal law enforcement efforts and if there is a compelling
30  need to protect the residents and infrastructure of this
31  state. Requests for state and local law enforcement personnel

SENATE AMENDMENT Bill No. CS for SB 2664 Amendment No. 1 Barcode 541372 1 to enforce these zones must be made to the Department of Law 2 Enforcement through the Florida Mutual Aid Plan described in 3 s. 23.1231. 4 (2) A person who knowingly operates a vessel, or 5 authorizes the operation of a vessel, in violation of the 6 restrictions of such a safety zone, security zone, regulated 7 navigation area, or naval vessel protection zone commits a 8 misdemeanor of the first degree, punishable as provided in s. 9 775.082 or s. 775.083. 10 (3) A person who continues to operate, or authorize 11 the operation of, a vessel in violation of the restrictions of 12 such a safety zone, security zone, regulated navigation area, 13 or naval vessel protection zone after being warned against 14 doing so, or who refuses to leave or otherwise cease violating 15 such a safety zone, security zone, regulated navigation area, 16 or naval vessel protection zone after having been ordered to 17 do so by a law enforcement officer or by competent military 18 authority, commits a felony of the third degree, punishable as 19 provided in s. 775.082, s. 775.083, or s. 775.084. 20 (4) A person who knowingly enters a safety zone, 21 security zone, 22 23 24 25 26 27 28 29 30 31 2 4:04 PM 04/20/04 s2664.cj.01
