6 | 400.235, Florida Statutes, is amended to read: |
7 | 400.235 Nursing home quality and licensure status; Gold |
8 | Seal Program.-- |
9 | (5) Facilities must meet the following additional criteria |
10 | for recognition as a Gold Seal Program facility: |
11 | (b) Evidence financial soundness and stability according |
12 | to standards adopted by the agency in administrative rule. Such |
13 | standards must include, but not be limited to, criteria for the |
14 | use of financial statements that are prepared in accordance with |
15 | generally accepted accounting principles and that are reviewed |
16 | or audited by certified public accountants. A nursing home that |
17 | is part of the same corporate entity as a continuing care |
18 | facility licensed under chapter 651 which meets the minimum |
19 | liquid reserve requirements specified in s. 651.035 and is |
20 | accredited by a recognized accrediting organization under s. |
21 | 651.028 and rules of the Office of Insurance Regulation |
22 | satisfies this requirement as long as the accreditation is not |
23 | provisional. Facilities operated by a federal or state agency |
24 | are deemed to be financially stable for purposes of applying for |
25 | the Gold Seal. |

27 | A facility assigned a conditional licensure status may not |
28 | qualify for consideration for the Gold Seal Program until after |
29 | it has operated for 30 months with no class I or class II |
30 | deficiencies and has completed a regularly scheduled relicensure |
31 | survey. |
