A bill to be entitled
2An act relating to temporary support; amending ss. 61.14
3and 742.031, F.S.; providing for modification of temporary
4support orders; providing an effective date.

6Be It Enacted by the Legislature of the State of Florida:

8     Section 1.  Subsection (9) is added to section 61.14,
9Florida Statutes, to read:
10     61.14  Enforcement and modification of support,
11maintenance, or alimony agreements or orders.--
12     (9)(a)  The court may, upon good cause shown, without a
13showing of a substantial change of circumstances, modify,
14vacate, or set aside a temporary support order before or upon
15entering its final order in the proceeding.
16     (b)  The modification of the temporary support order may be
17made retroactive to the date of the initial entry of that
18temporary support order, or to the date of the filing of the
19initial petition for dissolution of marriage, initial petition
20for support, initial petition to determine paternity, or
21supplemental petition for modification, or to a date prescribed
22in paragraph (1)(a) or s. 61.30(11)(c) or (17), as applicable.
23     Section 2.  Subsection (4) is added to section 742.031,
24Florida Statutes, to read:
25     742.031  Hearings; court orders for support, hospital
26expenses, and attorney's fee.--
27     (4)(a)  The court may, upon good cause shown, and without a
28showing of a substantial change of circumstances, modify,
29vacate, or set aside a temporary support order before or upon
30entering its final order in the proceeding.
31     (b)  The modification of the temporary support order may be
32made retroactive to the date of the initial entry of that
33temporary support order, or to the date of the filing of the
34initial petition for dissolution of marriage, initial petition
35for support, initial petition to determine paternity, or
36supplemental petition for modification, or to a date prescribed
37in s. 61.14(1)(a) or s. 61.30(11)(c) or (17), as applicable.
38     Section 3.  This act shall take effect July 1, 2004.
