13         Senate Amendment (with title amendment) 
14         On page 122, between lines 15 and 16,
15  
16  insert:  
17         Section 51.  Subsection (23) of section 287.057,
18  Florida Statutes, is amended to read:
19         (23)(a)  The department, in consultation with the State
20  Technology Office and the Chief Financial Officer Comptroller,
21  shall develop a program for on-line procurement of commodities
22  and contractual services and may contract for equipment and
23  services necessary to develop and implement the program. To
24  enable the state to promote open competition and to leverage
25  its buying power, agencies shall, participate in the on-line
26  procurement program, and eligible users may, use the on-line
27  procurement participate in the program. Only vendors
28  prequalified as meeting mandatory requirements and
29  qualifications criteria shall be permitted to participate in
30  on-line procurement. The department, in consultation with the
31  State Technology Office, may contract for equipment and

 1  services necessary to develop and implement on-line
 2  procurement.
 3         (b)  The department, in consultation with the State
 4  Technology Office, shall adopt rules, pursuant to ss.
 5  120.536(1) and 120.54, to administer the program for on-line
 6  procurement. The rules shall include, but not be limited to:
 7         1.  Determining the requirements and qualification
 8  criteria for prequalifying vendors.
 9         2.  Establishing the procedures for conducting on-line
10  procurement.
11         3.  Establishing the criteria for eligible commodities
12  and contractual services.
13         3. 4.  Establishing the procedures for providing access
14  to on-line procurement.
15         4. 5.  Determining the criteria warranting any
16  exceptions to the use of participation in the on-line
17  procurement program.
18         (c)  The department may collect fees for the use of the
19  on-line procurement program systems. Purchase of commodities
20  and contractual services from vendors that are registered with
21  the on-line procurement program may be considered use of the
22  program. The fees may be imposed on an individual transaction
23  basis and or as a fixed percentage of the cost savings
24  generated. At a minimum, the fees must be set in an amount
25  that covers sufficient to cover the projected costs of the
26  on-line procurement program such services, including the
27  administrative and project service costs in accordance with
28  the policies of the department; however, fees imposed on an
29  individual transaction basis may not exceed 1 percent of the
30  transaction amount. For the purposes of compensating the
31  provider, the department may authorize the provider to collect

 1  and retain a portion of the fees. The providers may withhold
 2  the portion retained from the amount of fees to be remitted to
 3  the department. The department may negotiate the retainage as
 4  a percentage of such fees charged to users, as a flat amount,
 5  or as any other method the department deems feasible. All fees
 6  and surcharges collected under this paragraph shall be
 7  collected by the department and deposited in the Grants and
 8  Donation Trust Fund as provided by law.

21         eligible commodities and contractual services;
22         deleting requirement that vendors be
23         prequalified for on-line procurement; revising
24         fees that may be charged for on-line
25         procurement; revising collection and deposit
26         methods for on-line procurement fees;
