1 A bill to be entitled
2 An act relating to fire safety; providing
3 definitions relating to an electrical utility
4 shut-off system; requiring that certain
5 specified buildings install an approved
6 electrical utility shut-off system; providing
7 dates for installing the system on existing and
8 newly-constructed buildings; authorizing the
9 State Fire Marshal to grant an extension of
10 time for installation under certain
11 circumstances; requiring the State Fire Marshal
12 to adopt rules; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Electrical utility fire protection shut-off
17 system required in existing and new construction buildings;
18 exceptions.--
19 (1) As used in this section, the term:
20 (a) "Commercial building" means any building that is
21 owned and operated by a person, firm, partnership, or
22 corporation which is used primarily for the wholesale or
23 retail sale of goods or services or manufacture of products or
24 any residential building that has more than four dwelling
25 units.
26 (b) "Residential building" means a building that is
27 designed, constructed, and used in whole or in part as a
28 dwelling for residential occupancy with four or fewer dwelling
29 units.

1 (2) Any commercial building and all residential
2 buildings that exceed two stories in height shall be protected
3 by an approved electrical utility shut-off system.
4 (3)(a) Notwithstanding any law to the contrary, any
5 commercial building and all residential buildings exceeding
6 two stories in height existing on July 1, 2004, or under
7 construction on that date, shall be protected by an approved
8 electrical utility shut-off system no later than June 30,
9 2009.
10 (b) If the State Fire Marshal determines that an
11 extension can be granted without creating an undue risk to
12 firefighters, the State Fire Marshal may grant a 1-year
13 extension to those building owners who have made a good faith
14 effort to comply with installing an approved electrical
15 utility shut-off system.
16 (4) Any commercial building and all residential
17 buildings exceeding two stories in height for which
18 construction started on or after July 1, 2005, shall have an
19 approved electrical utility shut-off system installed at the
20 time of construction.
21 (5)(a) The State Fire Marshal shall adopt rules to
22 administer this section.
23 (b) The State Fire Marshal shall adopt rules
24 establishing the minimum standards for the design and location
25 of an electrical utility shut-off system. The system, at a
26 minimum, must allow quick access to a firefighter during a
27 fire emergency and it must be located at a point on the
28 property of the building which does not endanger the
29 firefighter when he or she is attempting to shut down all
30 electric service to the building. The State Fire Marshal may
31 adopt by rule the standards of the National Fire Protection

1 Association or of any reputable national organization that has
2 standards for an electrical utility shut-off system.
3 (c) Each electrical utility shut-off system that is
4 required by this section must be serviced, repaired, tested,
5 inspected, and installed in compliance with this section and
6 with the rules adopted by the State Fire Marshal.
7 Section 2. This act shall take effect July 1, 2004.
