  1                      A bill to be entitled

  2         An act relating to the Emergency Planning and

  3         Community Right-to-Know Act; amending s.

  4         252.85, F.S.; updating a reference to

  5         substances listed in the Emergency Planning and

  6         Community Right-to-Know Act; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (3) of section 252.85, Florida

12  Statutes, is amended to read:

13         252.85  Fees.--

14         (3)  Any owner or operator of a facility that is

15  required to submit a report or filing under s. 313 of EPCRA

16  shall pay an annual reporting fee not to exceed $150 for those

17  s. 313 EPCRA listed substances in effect on January 1, 2004

18  1998. The department shall establish by rule the date by which

19  the fee is to be paid, as well as a formula or method of

20  determining the applicable fee under this subsection.

21         Section 2.  This act shall take effect July 1, 2004.

26  The CS differs from the bill as filed in that rather than
    deleting the reference to a hazardous substances list in the
27  federal Emergency Planning and Community Right-to-Know Act
    (EPCRA), it updates the date of the referenced list.
